Synopsis: Manufacturer's plates for subcomponent systems. Requires the secretary of state to adopt rules to establish a classification of dealer license plates for the manufacturers of vehicle subcomponent systems, and permits rules to be adopted prescribing the general conditions for use of license plates for the additional classification of manufacturers of vehicle subcomponent systems. Sets a $10 fee for a dealer license plate for a manufacturer of vehicle subcomponent systems. Requires the secretary of state to adopt interim written guidelines regarding the classification of dealer license plates for the manufacturers of vehicle subcomponent systems.

HOUSE BILL No. 1188



    A BILL FOR AN ACT to amend the Indiana Code concerning motor vehicles.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 9-13-2-97; (10)IN1188.1.1. -->     SECTION 1. IC 9-13-2-97, AS AMENDED BY P.L.147-2009, SECTION 4, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE UPON PASSAGE]: Sec. 97. (a) "Manufacturer" means, except as provided in subsection subsections (b) and (c), a person engaged in the business of constructing or assembling vehicles, of a type required to be registered under IC 9-18, at an established place of business. The term does not include a converter manufacturer, an automotive mobility dealer, or a recreational vehicle manufacturer.
     (b) "Manufacturer", for purposes of IC 9-18-26, in addition to a person described in subsection (a), includes a manufacturer of a vehicle subcomponent system.
    (b) (c) "Manufacturer", for purposes of IC 9-23, means a person who is engaged in the business of manufacturing or assembling new motor vehicles or major component parts of motor vehicles, or both, and sells new motor vehicles to dealers, wholesale dealers, distributors, or the general public. The term includes the following:
        (1) A factory branch office of the manufacturer.
        (2) An authorized representative of the manufacturer.
        (3) A partnership, a firm, an association, a joint venture, a limited liability company, a corporation, or a trust, resident or nonresident, that is controlled by the manufacturer.
The term does not include a converter manufacturer, an automotive mobility dealer, or a recreational vehicle manufacturer.
SOURCE: IC 9-18-26-2; (10)IN1188.1.2. -->     SECTION 2. IC 9-18-26-2, AS AMENDED BY P.L.106-2008, SECTION 6, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE UPON PASSAGE]: Sec. 2. (a) The secretary of state shall issue dealer license plates under this chapter according to the following classifications:
        (1) Dealer-new.
        (2) Dealer-used.
        (3) Manufacturer.
    (b) The secretary of state shall adopt rules under IC 4-22-2 to establish an additional classification of dealer license plates for the manufacturers of vehicle subcomponent systems and, by rule under IC 4-22-2, may prescribe the general conditions for the use of license plates for the additional classification of dealer license plates for manufacturers of vehicle subcomponent systems. The fee for a dealer license plate for a manufacturer of vehicle subcomponent systems is the fee under IC 9-29-5-14.5. The rules must provide that the dealer license plate for a manufacturer of vehicle subcomponent systems be displayed in accordance with IC 9-18-2-26.
    (b) (c) The secretary of state may adopt rules under IC 4-22-2 to establish additional classifications of dealer license plates and may prescribe the general conditions for usage of an additional classification. The secretary of state shall establish the classification of antique car museum dealer license plates.
SOURCE: IC 9-18-26-6; (10)IN1188.1.3. -->     SECTION 3. IC 9-18-26-6 IS AMENDED TO READ AS FOLLOWS [EFFECTIVE UPON PASSAGE]: Sec. 6. Except as provided in sections 7, and 8, and 8.5 of this chapter, dealer-new, dealer-used, and manufacturer license plates may only be used on motor vehicles in the:
        (1) dealer's inventory being held for sale;
        (2) usual operation of that manufacturer's or dealer's business;
        (3) movement of that manufacturer's or dealer's inventory; or
        (4) inventory of a manufacturer or dealer that is unattended by that manufacturer or dealer or the dealer's agent for a maximum of ten (10) days by a prospective buyer or a service customer.

AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE UPON PASSAGE]: Sec. 8.5. A dealer license plate for a manufacturer of vehicle subcomponent systems under section 2(b) of this chapter may be used in accordance with rules adopted by the secretary of state under IC 4-22-2.

SOURCE: IC 9-29-5-14.5; (10)IN1188.1.5. -->     SECTION 5. IC 9-29-5-14.5 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE UPON PASSAGE]: Sec. 14.5. The fee for a dealer license plate for a manufacturer of vehicle subcomponent systems under IC 9-18-26-2(b) is ten dollars ($10). There is no fee in addition to the regular registration fee for a license plate for a manufacturer of vehicle subcomponent systems.

[EFFECTIVE UPON PASSAGE] (a) Notwithstanding IC 9-18-26-2(b), as amended by this act, and IC 9-18-26-8.5, as added by this act, the secretary of state shall carry out the duties imposed upon the secretary of state under IC 9-18-26-2(b), as amended by this act, and IC 9-18-26-8.5, as added by this act, under interim written guidelines approved by the secretary of state.
    (b) This SECTION expires on the earlier of the following:
        (1) The date rules are adopted under IC 9-18-26-2(b), as amended by this act, and IC 9-18-26-8.5, as added by this act.
        (2) December 31, 2011.
