1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 3. The School Code is amended by changing Section
522-93 as follows:
6 (105 ILCS 5/22-93)
7 Sec. 22-93. School guidance counselor; gift ban.
8 (a) In this Section:
9 "School Guidance counselor" means a person employed by a
10school district and working in a high school to offer students
11advice and assistance in making career or college plans.
12 "Prohibited source" means any person who is employed by an
13institution of higher education or is an agent or spouse of or
14an immediate family member living with a person employed by an
15institution of higher education.
16 "Relative" means an individual related to another as
17father, mother, son, daughter, brother, sister, uncle, aunt,
18great-aunt, great-uncle, first cousin, nephew, niece, husband,
19wife, grandfather, grandmother, grandson, granddaughter,
20father-in-law, mother-in-law, son-in-law, daughter-in-law,
21brother-in-law, sister-in-law, stepfather, stepmother,
22stepson, stepdaughter, stepbrother, stepsister, half brother,
23or half sister or the father, mother, grandfather, or

1grandmother of the individual's spouse or the individual's
2fiance or fiancee.
3 (b) A school guidance counselor may not intentionally
4solicit or accept any gift from a prohibited source or solicit
5or accept a gift that would be in violation of any federal or
6State statute or rule. A prohibited source may not
7intentionally offer or make a gift that violates this Section.
8 (c) The prohibition in subsection (b) does not apply to
9any of the following:
10 (1) Opportunities, benefits, and services that are
11 available on the same conditions as for the general
12 public.
13 (2) Anything for which the school guidance counselor
14 pays the market value.
15 (3) A gift from a relative.
16 (4) Anything provided by an individual on the basis of
17 a personal friendship, unless the school guidance
18 counselor has reason to believe that, under the
19 circumstances, the gift was provided because of the
20 official position or employment of the school guidance
21 counselor and not because of the personal friendship. In
22 determining whether a gift is provided on the basis of
23 personal friendship, the school guidance counselor must
24 consider the circumstances in which the gift was offered,
25 including any of the following:
26 (A) The history of the relationship between the

1 individual giving the gift and the school guidance
2 counselor, including any previous exchange of gifts
3 between those individuals.
4 (B) Whether, to the actual knowledge of the school
5 guidance counselor, the individual who gave the gift
6 personally paid for the gift or sought a tax deduction
7 or business reimbursement for the gift.
8 (C) Whether, to the actual knowledge of the school
9 guidance counselor, the individual who gave the gift
10 also, at the same time, gave the same or a similar gift
11 to other school district employees.
12 (5) Bequests, inheritances, or other transfers at
13 death.
14 (6) Any item or items from any one prohibited source
15 during any calendar year having a cumulative total value
16 of less than $100.
17 (7) Promotional materials, including, but not limited
18 to, pens, pencils, banners, posters, and pennants.
19 (8) Travel, lodging, food, and beverage costs incurred
20 by the school counselor and paid by an institution of
21 higher education for attendance by the school counselor of
22 an educational or military program at the institution of
23 higher education. Any costs paid for by the institution of
24 higher education may not exceed the per diem rates for
25 travel, gift, and car expenses set by the federal Internal
26 Revenue Service and referenced in the Internal Revenue

1 Service's Publication 463 or a successor publication. As
2 used in this paragraph (8), "institution of higher
3 education" means any publicly or privately operated
4 university or college, public community college, business,
5 technical, or vocational school, military academy, or
6 other educational institution offering degrees and
7 instruction beyond the secondary school level.
8 Each exception listed under this subsection is mutually
9exclusive and independent of one another.
10 (d) A school guidance counselor is not in violation of
11this Section if he or she promptly takes reasonable action to
12return the gift to the prohibited source or donates the gift or
13an amount equal to its value to an appropriate charity that is
14exempt from income taxation under Section 501(c)(3) of the
15Internal Revenue Code of 1986.
16 A school guidance counselor or prohibited source who
17intentionally violates this Section is guilty of a business
18offense and is subject to a fine of at least $1,001 and up to
19$5,000.
