Bill Title: Amends the Public Utilities Act. Provides that the Illinois Commerce Commission shall protect the rights of residents to produce, consume, and store their own energy without discriminatory repercussions from a utility company. Provides that the Commission shall adopt rules that protect specified resident rights related to electricity production and storage. Provides that a resident who produces, consumes, and stores his or her own energy shall not face discriminatory rate design, treatment, or excessive compliance requirements as provided for in the Act. Effective immediately.

1 | AN ACT concerning regulation.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Public Utilities Act is amended by adding | |||||||||||||||||||
5 | Section 4-604 as follows:
| |||||||||||||||||||
6 | (220 ILCS 5/4-604 new) | |||||||||||||||||||
7 | Sec. 4-604. Right to self-generate electricity. | |||||||||||||||||||
8 | (a) The Commission shall protect the rights of residents to | |||||||||||||||||||
9 | produce, consume, and store their own energy without | |||||||||||||||||||
10 | discriminatory repercussions from a utility company. The | |||||||||||||||||||
11 | Commission shall adopt rules that ensure a resident may do the | |||||||||||||||||||
12 | following: | |||||||||||||||||||
13 | (1) generate, consume, and export renewable energy and | |||||||||||||||||||
14 | reduce his or her use of electricity obtained from the | |||||||||||||||||||
15 | grid; | |||||||||||||||||||
16 | (2) use technology to store energy at his or her | |||||||||||||||||||
17 | residence; | |||||||||||||||||||
18 | (3) connect his or her electrical system that generates | |||||||||||||||||||
19 | renewable energy, stores energy, or any combination | |||||||||||||||||||
20 | thereof, with the electricity meter on the customer's | |||||||||||||||||||
21 | premises that is provided by an electric utility: | |||||||||||||||||||
22 | (A) in a timely manner; | |||||||||||||||||||
23 | (B) in accordance with requirements established by |

1 | the electric utility to ensure the safety of utility | ||||||
2 | workers; and | ||||||
3 | (C) after providing written notice to the electric | ||||||
4 | utility providing service in the service territory, | ||||||
5 | installing a nomenclature plate on the electrical | ||||||
6 | meter panel and meeting all applicable state and local | ||||||
7 | safety and electrical code requirements associated | ||||||
8 | with installing a parallel distributed generation | ||||||
9 | system; and | ||||||
10 | (4) receive fair credit for energy exported to the | ||||||
11 | grid. | ||||||
12 | (b) A resident who produces, consumes, and stores his or | ||||||
13 | her own energy shall not face discriminatory rate design, | ||||||
14 | treatment, or excessive compliance requirements as provided by | ||||||
15 | paragraph (3) of subsection (n) of Section 16-107.5.

16 | Section 99. Effective date. This Act takes effect upon | ||||||
17 | becoming law.
