Bill Title: Amends the Electric Vehicle Rebate Act. Provides that, to be eligible to apply for an electric vehicle rebate, a purchaser must purchase or make a significant payment towards the purchase of (instead of purchase) an electric vehicle on or after July 1, 2022. Makes a conforming change. Provides that, if a person made a significant payment towards the purchase of the vehicle after July 1, 2022 but before the effective date of the amendatory Act, then the person may apply for the rebate within 90 days after the effective date of the amendatory Act. Effective immediately.

2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Electric Vehicle Rebate Act is amended by | |||||||||||||||||||
5 | changing Section 27 as follows:
| |||||||||||||||||||
6 | (415 ILCS 120/27) | |||||||||||||||||||
7 | Sec. 27. Electric vehicle rebate. | |||||||||||||||||||
8 | (a) Beginning July 1, 2022, and continuing as long as | |||||||||||||||||||
9 | funds are available, each person shall be eligible to apply | |||||||||||||||||||
10 | for a rebate, in the amounts set forth below, following the | |||||||||||||||||||
11 | purchase of an electric vehicle in Illinois. The Agency shall | |||||||||||||||||||
12 | issue rebates consistent with the provisions of this Act and | |||||||||||||||||||
13 | any implementing regulations adopted by the Agency. In no | |||||||||||||||||||
14 | event shall a rebate amount exceed the purchase price of the | |||||||||||||||||||
15 | vehicle. | |||||||||||||||||||
16 | (1) Beginning July 1, 2022, a $4,000 rebate for the | |||||||||||||||||||
17 | purchase of an electric vehicle that is not an electric | |||||||||||||||||||
18 | motorcycle. | |||||||||||||||||||
19 | (2) Beginning July 1, 2026, a $2,000 rebate for the | |||||||||||||||||||
20 | purchase of an electric vehicle that is not an electric | |||||||||||||||||||
21 | motorcycle. | |||||||||||||||||||
22 | (3) Beginning July 1, 2028, a $1,500 rebate for the | |||||||||||||||||||
23 | purchase of an electric vehicle that is not an electric |

2 | (4) Beginning July 1, 2022, a $1,500 rebate for the | ||||||
3 | purchase of an electric vehicle that is an electric | ||||||
4 | motorcycle. | ||||||
5 | (b) To be eligible to receive a rebate, a purchaser must: | ||||||
6 | (1) Reside in Illinois, both at the time the vehicle | ||||||
7 | was purchased and at the time the rebate is issued. | ||||||
8 | (2) Purchase or make a significant payment towards the | ||||||
9 | purchase of an electric vehicle in Illinois on or after | ||||||
10 | July 1, 2022 and be the owner of the vehicle at the time | ||||||
11 | the rebate is issued. Rented or leased vehicles, vehicles | ||||||
12 | purchased from an out-of-state dealership, and vehicles | ||||||
13 | delivered to or received by the purchaser out-of-state are | ||||||
14 | not eligible for a rebate under this Act. | ||||||
15 | (3) Apply for the rebate within 90 days after the | ||||||
16 | vehicle purchase date, and provide to the Agency proof of | ||||||
17 | residence, proof of vehicle ownership, and proof that the | ||||||
18 | vehicle was purchased in Illinois, including a copy of a | ||||||
19 | purchase agreement noting an Illinois seller. The | ||||||
20 | purchaser must notify the Agency of any changes in | ||||||
21 | residency or ownership of the vehicle that occur between | ||||||
22 | application for a rebate and issuance of a rebate. In this | ||||||
23 | paragraph, "vehicle purchase date" means the date the | ||||||
24 | person either (i) pays full price for the vehicle or (ii) | ||||||
25 | makes a significant payment towards the purchase of the | ||||||
26 | vehicle, whichever is first. |

1 | Notwithstanding the provisions of this paragraph, if a | ||||||
2 | person made a significant payment towards the purchase of | ||||||
3 | the vehicle after July 1, 2022 but before the effective | ||||||
4 | date of this amendatory Act of the 103rd General Assembly, | ||||||
5 | then the person may apply for the rebate within 90 days | ||||||
6 | after the effective date of this amendatory Act of the | ||||||
7 | 103rd General Assembly. | ||||||
8 | (c) The Agency shall make available in application | ||||||
9 | materials methods for purchasers to identify as low-income. | ||||||
10 | The Agency shall prioritize the review of qualified | ||||||
11 | applications from low-income purchasers and award rebates to | ||||||
12 | qualified purchasers accordingly. | ||||||
13 | (d) The purchaser must retain ownership of the vehicle for | ||||||
14 | a minimum of 12 consecutive months immediately after the | ||||||
15 | vehicle purchase date. The purchaser must continue to reside | ||||||
16 | in Illinois during that time frame and register the vehicle in | ||||||
17 | Illinois during that time frame. Rebate recipients who fail to | ||||||
18 | satisfy any of the above criteria will be required to | ||||||
19 | reimburse the Agency all or part of the original rebate amount | ||||||
20 | and shall notify the Agency within 60 days of failing to | ||||||
21 | satisfy the criteria. | ||||||
22 | (e) Rebates administered under this Section shall be | ||||||
23 | available for both new and used electric vehicles. | ||||||
24 | (f) A rebate administered under this Act may only be | ||||||
25 | applied for and awarded one time per vehicle identification | ||||||
26 | number. A rebate may only be applied for and awarded once per |
