| 3 | line 5, after "40", by inserting "and adding Section 22"; and

| 4 | on page 1, immediately below line 5, by inserting the | ||||||

| 6 | "(215 ILCS 121/22 new) | ||||||
| 7 | Sec. 22. Criminal history record
check; application for | ||||||
| 8 | certificate and certificate renewal. | ||||||
| 9 | (a) For the purpose of this Section, "fingerprints" means | ||||||
| 10 | an impression of the lines on the finger taken for the purpose | ||||||
| 11 | of identification. The impression may be electronic or in ink | ||||||
| 12 | converted to electronic format. | ||||||
| 13 | (b) In order to make a determination of certification | ||||||
| 14 | eligibility, the Director is authorized to require all | ||||||
| 15 | applicants for a certificate, including renewal applicants, to | ||||||
| 16 | undergo a fingerprint-based criminal history record check for | ||||||
| |||||||
| |||||||
| 1 | the first year following the effective date of this amendatory | ||||||
| 2 | Act of the 98th General Assembly. The applicant shall submit | ||||||
| 3 | his or her fingerprints to the Department of State Police in | ||||||
| 4 | the form and manner prescribed by the Department of State | ||||||
| 5 | Police. The fingerprints shall be transmitted by a live scan | ||||||
| 6 | fingerprint vendor licensed by the Department of Financial and | ||||||
| 7 | Professional Regulation. The fingerprints shall be checked | ||||||
| 8 | against the fingerprint records filed in the Department of | ||||||
| 9 | State Police and Federal Bureau of Investigation criminal | ||||||
| 10 | history records databases. The Department of State Police shall | ||||||
| 11 | charge a fee for conducting the criminal history record check, | ||||||
| 12 | which shall be deposited in the State Police Services Fund and | ||||||
| 13 | shall not exceed the actual cost of the State and national | ||||||
| 14 | criminal history record check. The Department of State Police | ||||||
| 15 | shall furnish, pursuant to positive identification, all | ||||||
| 16 | Illinois conviction information to the Department of Insurance | ||||||
| 17 | and shall forward the national criminal history record | ||||||
| 18 | information to the Department of Insurance.".
