Bill Title: Amends the Illinois Lottery Law. Creates a special instant scratch-off game for the benefit of the Lyme Disease Innovation Program, which helps to further education and awareness of Lyme disease in Illinois. Provides that the game shall commence on January 1, 2025 or as soon thereafter as is reasonably practical. Provides that funds raised from the purchase of the instant scratch-off game shall be deposited into the Lyme Disease Awareness Fund. Provides that the marketing of any other instant scratch-off game shall not be unreasonably diminished during the promotion and sale of the Lyme disease instant scratch-off. Makes conforming changes. Effective immediately.

2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Illinois Lottery Law is amended by changing | |||||||||||||||||||||||
5 | Sections 9.3 and 20 and by adding Section 21.18 as follows:

7 | Sec. 9.3. Expenditure and distribution of lottery | |||||||||||||||||||||||
8 | proceeds. | |||||||||||||||||||||||
9 | (a) Beginning July 1, 2022, except as provided in Sections | |||||||||||||||||||||||
10 | 21.4, 21.5, 21.6, 21.7, 21.8, 21.9, 21.10, 21.11, 21.13, | |||||||||||||||||||||||
11 | 21.15, and 21.16 , and 21.18 of this Law and Section 25-70 of | |||||||||||||||||||||||
12 | the Sports Wagering Act, the Department shall distribute all | |||||||||||||||||||||||
13 | proceeds of lottery tickets and shares sold in the following | |||||||||||||||||||||||
14 | priority and manner: | |||||||||||||||||||||||
15 | (1) The payment of prizes and retailer bonuses. | |||||||||||||||||||||||
16 | (2) The payment of costs incurred in the operation and | |||||||||||||||||||||||
17 | administration of the Lottery, including the payment of | |||||||||||||||||||||||
18 | sums due to the private manager under the management | |||||||||||||||||||||||
19 | agreement with the Department and including costs of | |||||||||||||||||||||||
20 | administering the Lottery sports wagering program pursuant | |||||||||||||||||||||||
21 | to Section 25-70 of the Sports Wagering Act. | |||||||||||||||||||||||
22 | (3) On the last day of each month or as soon thereafter | |||||||||||||||||||||||
23 | as possible, the State Comptroller shall direct and the |

1 | State Treasurer shall transfer from the State Lottery Fund | ||||||
2 | to the Common School Fund the Department's estimate of net | ||||||
3 | lottery proceeds. | ||||||
4 | (4) If an amount in excess of the annual net lottery | ||||||
5 | proceeds is transferred for a fiscal year, then the | ||||||
6 | Department shall offset the monthly transfers of estimated | ||||||
7 | net lottery proceeds during the following fiscal year by | ||||||
8 | that excess amount. If an amount less than the annual net | ||||||
9 | lottery proceeds is transferred for a fiscal year, then | ||||||
10 | after the related annual fiscal year audit is completed | ||||||
11 | following such fiscal year, the Department shall direct | ||||||
12 | the deposit of any remaining annual net lottery proceeds | ||||||
13 | from such fiscal year, subject to payments under | ||||||
14 | paragraphs (1) and (2), into the Common School Fund as | ||||||
15 | soon thereafter as possible. | ||||||
16 | (b) The net lottery proceeds shall be determined by | ||||||
17 | deducting from total annual lottery proceeds the expenditures | ||||||
18 | required by paragraphs (1) and (2) of subsection (a). The | ||||||
19 | total annual lottery proceeds and annual net lottery proceeds | ||||||
20 | shall be determined according to generally accepted accounting | ||||||
21 | principles for governmental entities and verified by an annual | ||||||
22 | fiscal year audit. | ||||||

25 | Sec. 20. State Lottery Fund. |

1 | (a) There is created in the State Treasury a special fund | ||||||
2 | to be known as the State Lottery Fund. Such fund shall consist | ||||||
3 | of all revenues received from (1) the sale of lottery tickets | ||||||
4 | or shares, (net of commissions, fees representing those | ||||||
5 | expenses that are directly proportionate to the sale of | ||||||
6 | tickets or shares at the agent location, and prizes of less | ||||||
7 | than $600 which have been validly paid at the agent level), (2) | ||||||
8 | application fees, and (3) all other sources including moneys | ||||||
9 | credited or transferred thereto from any other fund or source | ||||||
10 | pursuant to law. Interest earnings of the State Lottery Fund | ||||||
11 | shall be credited to the Common School Fund. | ||||||
12 | (a-5) The receipt and distribution of moneys under Section | ||||||
13 | 21.4 of this Act shall be in accordance with Section 21.4. | ||||||
14 | (b) The receipt and distribution of moneys under Section | ||||||
15 | 21.5 of this Law shall be in accordance with Section 21.5. | ||||||
16 | (c) The receipt and distribution of moneys under Section | ||||||
17 | 21.6 of this Law shall be in accordance with Section 21.6. | ||||||
18 | (d) The receipt and distribution of moneys under Section | ||||||
19 | 21.7 of this Law shall be in accordance with Section 21.7. | ||||||
20 | (e) The receipt and distribution of moneys under Section | ||||||
21 | 21.8 of this Law shall be in accordance with Section 21.8. | ||||||
22 | (f) The receipt and distribution of moneys under Section | ||||||
23 | 21.9 of this Law shall be in accordance with Section 21.9. | ||||||
24 | (g) The receipt and distribution of moneys under Section | ||||||
25 | 21.10 of this Law shall be in accordance with Section 21.10. | ||||||
26 | (h) The receipt and distribution of moneys under Section |

7 | Section 25-70 of the Sports Wagering Act. | ||||||
8 | (l) The receipt and distribution of moneys under Section | ||||||
9 | 21.15 of this Law shall be in accordance with Section 21.15. | ||||||
10 | (m) The receipt and distribution of moneys under Section | ||||||
11 | 21.16 of this Law shall be in accordance with Section 21.16. | ||||||
12 | (n) The receipt and distribution of moneys under Section | ||||||
13 | 21.18 of this Law shall be in accordance with Section 21.18. | ||||||

16 | Sec. 21.18. Scratch-off for the Lyme Disease Innovation | ||||||
17 | Program. | ||||||
18 | (a) The Department shall offer a special instant | ||||||
19 | scratch-off game for the benefit of the Lyme Disease | ||||||
20 | Innovation Program, which helps to further education and | ||||||
21 | awareness of Lyme disease in Illinois. The game shall commence | ||||||
22 | on January 1, 2025 or as soon thereafter, at the discretion of | ||||||
23 | the Director, as is reasonably practical. The operation of the | ||||||
24 | game shall be governed by this Law and any rules adopted by the | ||||||
25 | Department. |

1 | (b) The net revenue from the Lyme Disease Innovation | ||||||
2 | Program scratch-off game shall be deposited into the Lyme | ||||||
3 | Disease Awareness Fund. | ||||||
4 | Moneys received for the purposes of this Section, | ||||||
5 | including, without limitation, net revenue from the special | ||||||
6 | instant scratch-off game and from gifts, grants, and awards | ||||||
7 | from any public or private entity, must be deposited into the | ||||||
8 | Fund. Any interest earned on moneys in the Fund must be | ||||||
9 | deposited into the Fund. | ||||||
10 | As used in this subsection, "net revenue" means the total | ||||||
11 | amount for which tickets have been sold less the sum of the | ||||||
12 | amount paid out in the prizes and to retailers, and direct and | ||||||
13 | estimated administrative expenses of the Department solely | ||||||
14 | related to the scratch-off game under this Section. | ||||||
15 | (c) During the time that tickets are sold for the Lyme | ||||||
16 | Disease Innovation Program scratch-off game, the Department | ||||||
17 | shall not unreasonably diminish the efforts devoted to | ||||||
18 | marketing any other instant scratch-off lottery game. | ||||||
19 | (d) The Department may adopt any rules necessary to | ||||||
20 | implement and administer the provisions of this Section.
