Bill Title: Amends the Public Utilities Act. Provides that provisions concerning notice to terminate or cut off service or supply apply to any public utility, two or more public utilities, or broadband service providers (rather than any public utility or two or more public utilities furnishing electricity or gas for space heating during specified months). Provides that specified notice shall be delivered at least 7 calendar days prior to the termination of service or supply. Provides that no public official to whom notice is given shall be liable for death, injury, or damages resulting from cut-off of public utility (rather than electricity or gas) service or supply. Effective August 1, 2022.

1 AN ACT concerning regulation.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Public Utilities Act is amended by changing
5Section 8-202 as follows:
6 (220 ILCS 5/8-202) (from Ch. 111 2/3, par. 8-202)
7 Sec. 8-202. Any public utility, or two or more public
8utilities, or broadband service provider, must which furnishes
9electricity or gas for space heating shall, during the
10calendar months of November, December, January, February, and
11March:
12 (a) give written notice of its intention to terminate or
13cut off such service or supply for any reason, other than by
14request of the customer, to the customer. Such notice shall be
15sent by U.S. Mail at least 8 days prior to termination of
16service or supply or delivered by other means to the customer 5
17days prior to such termination; and
18 (b) deliver written notice of intention to terminate or
19cut off such service or supply for any reason, other than by
20request of the customer, to the Director of the local
21department of public health or, if there is no local
22department of public health, then to the township supervisor
23or, if there is no township supervisor, then to the county

1sheriff where the premises receiving such service or supply is
2located; and
3 (c) send, by certified mail, prior written notice of its
4intention to terminate or cut off such service or supply for
5any reason, other than by request of the customer, to the owner
6of record and/or the mortgagee of the premises receiving such
7service or supply, should the owner of record or mortgagee
8make request to the public utility for any such notice.
9 The notice required by paragraph (b) of this Section shall
10be delivered at least 7 calendar days prior to the termination
11of service or supply.
12 The notice required by paragraph paragraphs (b) and (c) of
13this Section shall be delivered or mailed at least 24 hours and
14not more than 48 hours prior to the termination of service or
15supply.
16 Any termination notice delivered or mailed to a customer
17shall include a statement advising said customer that the
18township supervisor, local department of public health, or
19county sheriff, and the owner and/or the mortgagee, if
20applicable, will be notified of the termination action at
21least 24 hours prior to the termination of service or supply.
22 Nothing in this Act shall be construed to limit the power
23of the Commission to adopt other rules and regulations
24pursuant to service termination notices.
25 No public official to whom notice is given pursuant to
26subparagraph (b) of this Section shall be liable for death,

4 Section 99. Effective date. This Act takes effect August
