1 | AMENDMENT TO SENATE BILL 2780

2 | AMENDMENT NO. ______. Amend Senate Bill 2780 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Criminal Code of 1961 is amended by adding | ||||||
5 | Section 24-3.5-5 as follows:
| ||||||
6 | (720 ILCS 5/24-3.5-5 new) | ||||||
7 | Sec. 24-3.5-5. Persons prohibited from receiving firearms | ||||||
8 | under federal law; prohibited receipt, possession, transport, | ||||||
9 | or carrying. | ||||||
10 | (a) It is unlawful for an individual in the course of their | ||||||
11 | employment to receive, possess, transport, or carry any firearm | ||||||
12 | or ammunition while: (1) being employed for any person who | ||||||
13 | cannot own, possess, or acquire a firearm under 18 U.S.C. | ||||||
14 | 922(g); and (2) having knowledge of the prohibition on | ||||||
15 | ownership, possession or acquisition of firearms by that | ||||||
16 | person. |

1 | (b) It is unlawful for an individual who cannot own, | ||||||
2 | possess, or acquire a firearm under 18 U.S.C. 922 (g), to | ||||||
3 | direct another person to receive, possess, transport, or carry | ||||||
4 | any firearm or ammunition. | ||||||
5 | (c) Sentence. A violation of subsection (a) of this Section | ||||||
6 | is a Class 3 felony. A violation of subsection (b) of this | ||||||
7 | Section is a Class 1 felony.

8 | Section 99. Effective date. This Act takes effect upon | ||||||
9 | becoming law.".
