Bill Title: Amends the Counties Code, Township Code, and Illinois Municipal Code. Provides that a disabled veteran or his or her caregiver shall not be charged any building permit fee for improvements to the residence of the disabled veteran if the improvements are required to accommodate a service-connected disability. Provides that required paperwork to obtain a building permit shall still be submitted. Limits home rule powers. Effective January 1, 2021.

1 AN ACT concerning local government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Counties Code is amended by adding Section
55-12022 as follows:
6 (55 ILCS 5/5-12022 new)
7 Sec. 5-12022. Disabled veteran building permit fee.
8 (a) A disabled veteran or his or her caregiver shall not be
9charged any building permit fee for improvements to the
10residence of the disabled veteran if the improvements are
11required to accommodate a service-connected disability.
12Nothing in this subsection removes the responsibility to submit
13required paperwork to the county in order to obtain a building
14permit.
15 (b) A home rule county may not regulate building permit
16fees in a manner inconsistent with this Section. This Section
17is a limitation under subsection (i) of Section 6 of Article
18VII of the Illinois Constitution on the concurrent exercise by
19home rule units of powers and functions exercised by the State.
20 Section 10. The Township Code is amended by adding Section
21110-17 as follows:

3disabled veteran or his or her caregiver shall not be charged
4any building permit fee for improvements to the residence of
5the disabled veteran if the improvements are required to
6accommodate a service-connected disability. Nothing in this
7Section removes the responsibility to submit required
8paperwork to the township in order to obtain a building permit.
9 Section 15. The Illinois Municipal Code is amended by
10adding Section 11-13-28 as follows:
11 (65 ILCS 5/11-13-28 new)
12 Sec. 11-13-28. Disabled veteran building permit fee.
13 (a) A disabled veteran or his or her caregiver shall not be
14charged any building permit fee for improvements to the
15residence of the disabled veteran if the improvements are
16required to accommodate a service-connected disability.
17Nothing in this subsection removes the responsibility to submit
18required paperwork to the municipality in order to obtain a
19building permit.
20 (b) A home rule municipality may not regulate building
21permit fees in a manner inconsistent with this Section. This
22Section is a limitation under subsection (i) of Section 6 of
23Article VII of the Illinois Constitution on the concurrent
24exercise by home rule units of powers and functions exercised

2 Section 99. Effective date. This Act takes effect January
31, 2021.
