Bill Title: Amends the Counties Code, Township Code, and Illinois Municipal Code. Provides that a disabled veteran or his or her caregiver shall not be charged any building permit fee for improvements to the residence of the disabled veteran if the improvements are required to accommodate a service-connected disability. Provides that required paperwork to obtain a building permit shall still be submitted. Limits home rule powers. Effective January 1, 2021.

| 1 | AN ACT concerning local government.
| ||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The Counties Code is amended by adding Section | ||||||
| 5 | 5-12022 as follows:
| ||||||
| 6 | (55 ILCS 5/5-12022 new) | ||||||
| 7 | Sec. 5-12022. Disabled veteran building permit fee. | ||||||
| 8 | (a) A disabled veteran or his or her caregiver shall not be | ||||||
| 9 | charged any building permit fee for improvements to the | ||||||
| 10 | residence of the disabled veteran if the improvements are | ||||||
| 11 | required to accommodate a service-connected disability. | ||||||
| 12 | Nothing in this subsection removes the responsibility to submit | ||||||
| 13 | required paperwork to the county in order to obtain a building | ||||||
| 14 | permit. | ||||||
| 15 | (b) A home rule county may not regulate building permit | ||||||
| 16 | fees in a manner inconsistent with this Section. This Section | ||||||
| 17 | is a limitation under subsection (i) of Section 6 of Article | ||||||
| 18 | VII of the Illinois Constitution on the concurrent exercise by | ||||||
| 19 | home rule units of powers and functions exercised by the State.

| 20 | Section 10. The Township Code is amended by adding Section | ||||||
| 21 | 110-17 as follows:

| 2 | Sec. 110-17. Disabled veteran building permit fee. A | ||||||
| 3 | disabled veteran or his or her caregiver shall not be charged | ||||||
| 4 | any building permit fee for improvements to the residence of | ||||||
| 5 | the disabled veteran if the improvements are required to | ||||||
| 6 | accommodate a service-connected disability. Nothing in this | ||||||
| 7 | Section removes the responsibility to submit required | ||||||
| 8 | paperwork to the township in order to obtain a building permit.

| 9 | Section 15. The Illinois Municipal Code is amended by | ||||||
| 10 | adding Section 11-13-28 as follows:
| ||||||
| 11 | (65 ILCS 5/11-13-28 new) | ||||||
| 12 | Sec. 11-13-28. Disabled veteran building permit fee. | ||||||
| 13 | (a) A disabled veteran or his or her caregiver shall not be | ||||||
| 14 | charged any building permit fee for improvements to the | ||||||
| 15 | residence of the disabled veteran if the improvements are | ||||||
| 16 | required to accommodate a service-connected disability. | ||||||
| 17 | Nothing in this subsection removes the responsibility to submit | ||||||
| 18 | required paperwork to the municipality in order to obtain a | ||||||
| 19 | building permit. | ||||||
| 20 | (b) A home rule municipality may not regulate building | ||||||
