Bill Title: Amends the Election Code. AN ACT concerning elections.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Election Code is amended by adding Section
9-11.5 as follows:
(10 ILCS 5/9-11.5 new)
Sec. 9-11.5. Contributor's occupation and employer.
(a) With respect to a contribution for which a political
committee is required by this Article to include in its
contribution report the contributor's occupation and employer
or a statement of the committee's good faith effort to
ascertain that information, beginning January 1, 2011 if the
committee fails to ascertain the contributor's occupation and
employer within 30 days after receiving the contribution, then
the political committee promptly shall return to that
contributor the amount of the contribution in excess of $500.
(b) A political committee shall amend any contribution
report it filed under this Article on or after the effective
date of this amendatory Act of the 96th General Assembly in
which the committee included a statement of its good faith
effort to ascertain a contributor's occupation and employer.
The amended report shall either (i) state the contributor's
occupation and employer or (ii) certify that the committee has

returned to the contributor the amount required by subsection
(a). The committee shall file the amended report by the 5th day
after (i) the original report was filed or (ii) the 30-day
period described in subsection (a) expired, whichever occurs
later.
(c) The State Board of Elections may impose a civil penalty
upon any political committee that knowingly fails to comply
with this Section.
Section 99. Effective date. This Act takes effect January
1, 2011.
