SYNOPSIS AS INTRODUCED:
10 ILCS 5/9-11.5 new

Amends the Election Code. Requires that if a political committee does not make the good faith effort required to ascertain the occupation and employer of a campaign contributor of more than $500 within 30 days after receiving the contribution, then the committee must return to the contributor the amount in excess of $500. Effective January 1, 2011.

1 AN ACT concerning elections.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Election Code is amended by adding Section
5 9-11.5 as follows:
6 (10 ILCS 5/9-11.5 new)
7 Sec. 9-11.5. Contributor's occupation and employer.
8 (a) With respect to a contribution for which a political
9 committee is required by this Article to include in its
10 contribution report the contributor's occupation and employer
11 or a statement of the committee's good faith effort to
12 ascertain that information, beginning January 1, 2011 if the
13 committee fails to ascertain the contributor's occupation and
14 employer within 30 days after receiving the contribution, then
15 the political committee promptly shall return to that
16 contributor the amount of the contribution in excess of $500.
17 (b) A political committee shall amend any contribution
18 report it filed under this Article on or after the effective
19 date of this amendatory Act of the 96th General Assembly in
20 which the committee included a statement of its good faith
21 effort to ascertain a contributor's occupation and employer.
22 The amended report shall either (i) state the contributor's
23 occupation and employer or (ii) certify that the committee has

1 returned to the contributor the amount required by subsection
2 (a). The committee shall file the amended report by the 5th day
3 after (i) the original report was filed or (ii) the 30-day
4 period described in subsection (a) expired, whichever occurs
5 later.
6 (c) The State Board of Elections may impose a civil penalty
7 upon any political committee that knowingly fails to comply
8 with this Section.
9 Section 99. Effective date. This Act takes effect January
10 1, 2011.
