Bill Title: Amends the Illinois Procurement Code. Provides that each State agency entering into or maintaining a contract for the purchase of food under the Code shall adopt a policy that permits the donation of leftover food procured by State funds. Provides that the policy shall address any daily food operations run by the agency, including one-time events, and shall contain a list of nearby soup kitchens, food pantries, and other non-profit organizations where leftover food can be donated. Requires each State agency to circulate its policy to all agency employees, and submit its food donation policy to the Department of Central Management Services on an annual basis beginning December 31, 2018. Effective immediately.

SYNOPSIS AS INTRODUCED:
30 ILCS 500/55-20

Amends the Illinois Procurement Code. Provides that each State agency entering into or maintaining a contract for the purchase of food under the Code shall adopt a policy that permits the donation of leftover food procured by State funds. Provides that the policy shall address any daily food operations run by the agency, including one-time events, and shall contain a list of nearby soup kitchens, food pantries, and other non-profit organizations where leftover food can be donated. Requires each State agency to circulate its policy to all agency employees, and submit its food donation policy to the Department of Central Management Services on an annual basis beginning December 31, 2018. 1 AN ACT concerning finance.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Procurement Code is amended by
5changing Section 55-20 as follows:
6 (30 ILCS 500/55-20)
7 Sec. 55-20. Contracts for food donation; food donation
8policy.
9 (a) After the effective date of this amendatory Act of the
1099th General Assembly, a public entity shall not enter into a
11contract to purchase food with a bidder or offeror if the
12bidder's or offeror's contract terms prohibit the public entity
13from donating food to food banks, including, but not limited
14to, homeless shelters, food pantries, and soup kitchens.
15 (b) Each State agency entering into or maintaining a
16contract for the purchase of food under this Code shall adopt a
17policy that permits the donation of leftover food procured by
18State funds. The policy shall address any daily food operations
19run by the agency, including one-time events, and shall contain
20a list of nearby soup kitchens, food pantries, and other
21non-profit organizations where leftover food can be donated.
22Each State agency shall circulate its policy to all agency
