Bill Title: Amends various Acts relating to the governance of public universities and community colleges in Illinois. Provides that if a student has a personal support worker through the Home-Based Support Services Program for Adults with Mental Disabilities under the Developmental Disability and Mental Disability Services Act, the governing board of the public university or community college district must permit the personal support worker to attend class with the student but is not responsible for providing or paying for the personal support worker. Provides that if the personal support worker's attendance in class is solely to provide personal support services to the student, the governing board may not charge the personal support worker tuition and fees for such attendance. Effective immediately.

| 1 | AN ACT concerning education.

| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The University of Illinois Act is amended by | ||||||
| 5 | adding Section 120 as follows:
| ||||||
| 6 | (110 ILCS 305/120 new) | ||||||
| 7 | Sec. 120. Personal support worker's attendance in class | ||||||
| 8 | permitted. If a student of the University has a personal | ||||||
| 9 | support worker through the Home-Based Support
Services Program | ||||||
| 10 | for Adults with Mental Disabilities under the
Developmental | ||||||
| 11 | Disability and Mental Disability Services Act, the Board of | ||||||
| 12 | Trustees must permit the personal support worker to attend | ||||||
| 13 | class with the student but is not responsible for providing or | ||||||
| 14 | paying for the personal support worker. If the personal support | ||||||
| 15 | worker's attendance in class is solely to provide personal | ||||||
| 16 | support services to the student, the Board may not charge the | ||||||
| 17 | personal support worker tuition and fees for such attendance.

| 18 | Section 10. The Southern Illinois University Management | ||||||
| 19 | Act is amended by adding Section 100 as follows:
| ||||||

| 20 | Disability and Mental Disability Services Act, the Board must | ||||||
| 21 | permit the personal support worker to attend class with the | ||||||

| 7 | permitted. If a student of the University has a personal | ||||||

| 10 | Disability and Mental Disability Services Act, the Board must | ||||||
| 11 | permit the personal support worker to attend class with the | ||||||

| 17 | Section 50. The Public Community College Act is amended by | ||||||
| 18 | adding Section 3-29.14 as follows:

| 19 | (110 ILCS 805/3-29.14 new) | ||||||
| 20 | Sec. 3-29.14. Personal support worker's attendance in | ||||||
| 21 | class permitted. If a student of a community college district | ||||||
| 22 | has a personal support worker through the Home-Based Support | ||||||

| 1 | Services Program for Adults with Mental Disabilities under the
| ||||||
| 2 | Developmental Disability and Mental Disability Services Act, | ||||||
| 3 | the board must permit the personal support worker to attend | ||||||
| 4 | class with the student but is not responsible for providing or | ||||||
| 5 | paying for the personal support worker. If the personal support | ||||||
| 6 | worker's attendance in class is solely to provide personal | ||||||
| 7 | support services to the student, the board may not charge the | ||||||

| 9 | Section 99. Effective date. This Act takes effect upon | ||||||
| 10 | becoming law.
