Bill Title: Amends the Conversion and Formation of School Districts Article of the School Code. Within 3 years after the effective date of the amendatory Act, requires elementary districts and high school districts to form new unit districts, notwithstanding any referendum requirements or any other laws to the contrary. Provides that the State Board of Education shall facilitate the creation of the new unit districts by providing recommendations on which districts must consolidate. Sets forth the factors that the State Board must take into consideration. Effective immediately.

1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The School Code is amended by adding Section
511E-132 as follows:
6 (105 ILCS 5/11E-132 new)
7 Sec. 11E-132. Elementary and high school district
8consolidation required. Within 3 years after the effective date
9of this amendatory Act of the 101st General Assembly,
10elementary districts and high school districts shall form new
11unit districts, notwithstanding any referendum requirements or
12any other laws to the contrary. The State Board of Education
13shall facilitate the creation of the new unit districts by
14providing recommendations on which districts must consolidate.
15The State Board shall take into consideration the location of
16the affected districts in relationship to each other, the
17school needs and conditions of the affected districts and in
18the area adjacent to those districts, the classification of
19funds and assets that will result from the consolidation, the
20best interests of the schools of the affected districts, and
21the best interests and the educational welfare of the pupils
22residing in the affected districts.

1 Section 99. Effective date. This Act takes effect upon
