| 1 | | AN ACT concerning civil law.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 1. Short title. This Act may be cited as the Public |
| 5 | | Duty Rule Codification Act.
|
| 6 | | Section 5. Findings; purpose. |
| 7 | | (a) The General Assembly finds: |
| 8 | | (1) On January 22, 2016, the Illinois Supreme Court, |
| 9 | | in Coleman v. East Joliet Fire Protection District, 2016 |
| 10 | | IL 117952, abolished the public duty rule. |
| 11 | | (2) The public duty rule is an important doctrine that |
| 12 | | is grounded in the principle that the duty of a local |
| 13 | | governmental entity to preserve the well-being of the |
| 14 | | community is owed to the public at large rather than to |
| 15 | | specific members of the community. |
| 16 | | (b) It is the purpose of this Act to codify the public duty |
| 17 | | rule.

| 19 | | and its employees owe no duty of care to individual members of |
| 20 | | the general public to provide governmental services.
