Bill Title: Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that, for a person who is a resident in a facility licensed under the Nursing Home Care Act for whom payments are made under the Article throughout a month and who is determined to be eligible for medical assistance, the State shall pay an amount in addition to the minimum monthly personal needs allowance authorized under the Social Security Act so that the person's total monthly personal needs allowance from both State and federal sources equals $60. Effective immediately.

305 ILCS 5/5-35.5 new

Amends the Medical Assistance Article of the Illinois Public Aid Code. 1 AN ACT concerning public aid.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Public Aid Code is amended by
5adding Section 5-35.5 as follows:
6 (305 ILCS 5/5-35.5 new)
7 Sec. 5-35.5. Personal needs allowance; nursing home
8residents. For a person who is a resident in a facility
9licensed under the Nursing Home Care Act for whom payments are
10made under this Article throughout a month and who is
11determined to be eligible for medical assistance under this
12Article, the State shall pay an amount in addition to the
13minimum monthly personal needs allowance authorized under
14Section 1902(q)(1)(a) of Title XIX of the Social Security Act
15(42 U.S.C. 1396a) so that the person's total monthly personal
16needs allowance from both State and federal sources equals
17$60.
18 Section 99. Effective date. This Act takes effect upon
19becoming law.
