Bill Title: Amends the Environmental Protection Act. Requires the Environmental Protection Agency to establish a Fleet Electrification Incentive Program to promote the use of electric trucks by fleet owners by offering a voucher of $200,000 per electric Class 6 truck, electric Class 7 truck, or electric Class 8 truck purchased or leased for a fleet by the fleet's owner or operator. Provides that an applicant shall submit a proof of purchase, lease, or other binding contract regarding the electric Class 6 truck, electric Class 7 truck, or electric Class 8 truck in order to be awarded the voucher. Requires an applicant who is awarded a voucher to agree to participate in annual surveys on specified metrics. Contains other program requirements. Defines "Class 6 truck", "Class 7 truck", and "Class 8 truck".

1 AN ACT concerning safety.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Environmental Protection Act is amended by
5adding Section 9.19 as follows:
6 (415 ILCS 5/9.19 new)
7 Sec. 9.19. Fleet Electrification Incentive Program.
8 (a) In this Section:
9 "Class 6 truck" means a truck categorized by the Federal
10Highway Administration, using gross vehicle weight ratings, as
11a Class 6 vehicle.
12 "Class 7 truck" means a truck categorized by the Federal
13Highway Administration, using gross vehicle weight ratings, as
14a Class 7 vehicle.
15 "Class 8 truck" means a truck categorized by the Federal
16Highway Administration, using gross vehicle weight ratings, as
17a Class 8 vehicle.
18 (b) The Agency shall establish a Fleet Electrification
19Incentive Program to provide private fleet owners and
20operators in Illinois grants to promote their use of electric
21Class 6 trucks, electric Class 7 trucks, and electric Class 8
22trucks. The Program shall offer qualifying applicants a grant
23of $200,000 per electric Class 6 truck, electric Class 7

1truck, or electric Class 8 truck purchased or leased for a
2private fleet by the fleet's owner or operator.
3 (c) The Agency shall award grants under the Fleet
4Electrification Incentive Program on a competitive basis
5according to the availability of funding. To be eligible to
6receive a grant under the Program an applicant must, at a
7minimum, satisfy all of the following criteria:
8 (1) The electric Class 6 truck, electric Class 7
9 truck, or electric Class 8 truck must be registered in
10 Illinois or recognized under the International
11 Registration Plan.
12 (2) The fleet owner or operator must be domiciled in
13 Illinois.
14 (3) If the electric Class 6 truck, electric Class 7
15 truck, or electric Class 8 truck is leased by the fleet
16 owner or operator, the term of the lease must be at least
17 36 months.
18 In providing grants under the Program, the Agency may give
19weight to applications based upon the potential impact of the
20geographic locations and routes of the applicant's fleet on
21pollution affecting environmental justice communities.
22 In providing grants under the Program, the Agency shall
23give priority to applicants who have negotiated and entered
24into a collective bargaining agreement at the time of
25application for the grant.
26 (d) A grant provided under the Program is limited to a

1maximum award of $200,000 to purchase or lease one electric
2Class 6 truck, electric Class 7 truck, or electric Class 8
3truck. However, a fleet owner or operator may submit one
4application for each diesel Class 6 truck, diesel Class 7
5truck, or diesel Class 8 truck eligible to be replaced under
6the Program and that is owned by the fleet owner or operator. A
7fleet owner or operator may be awarded multiple grants under
8the Program.
9 (e) The Agency shall notify an applicant when the
10applicant's grant request has been granted preliminary
11approval by the Agency. After an applicant receives
12notification that the applicant's grant request has been
13granted preliminary approval by the Agency, the applicant
14shall submit a proof of purchase, lease, or other binding
15contract regarding the electric Class 6 truck, electric Class
167 truck, or electric Class 8 truck in order to be awarded the
17grant. The preliminary approval of the grant request may be
18renewed at 3-month intervals for up to 18 months, pending
19receipt of the applicant's proof of purchase, lease, or other
20binding contract regarding the purchase or leasing of the
21electric Class 6 truck, electric Class 7 truck, or electric
22Class 8 truck.
23 (f) A fleet owner or operator who receives a grant under
24this Section must retain title or right of use of the electric
25Class 6 truck, electric Class 7 truck, or electric Class 8
26truck incentivized under the Program for a minimum of 60

1consecutive months after the purchase date or lease date of
2the electric Class 6 truck, electric Class 7 truck, or
3electric Class 8 truck. Resale or sublease of the electric
4Class 6 truck, electric Class 7 truck, or electric Class 8
5truck for financial gain within 60 months after the purchase
6date or lease date is prohibited.
7 (g) Upon approval of an initial application for a grant
8under the Program, the applicant may participate in a vehicle
9replacement program through which:
10 (1) a diesel Class 6 truck, diesel Class 7 truck, or
11 diesel Class 8 truck from the applicant's existing fleet
12 is scrapped; or
13 (2) ownership of the oldest diesel Class 6 truck,
14 diesel Class 7 truck, or diesel Class 8 truck in the
15 applicant's existing fleet is transferred to another fleet
16 owner or operator who agrees to scrap their oldest diesel
17 Class 6 truck, diesel Class 7 truck, or diesel Class 8
18 truck upon receipt.
19 The electric Class 6 truck, electric Class 7 truck, or
20electric Class 8 truck for which the grant is awarded must be
21predominantly used in the same general location in Illinois as
22the fleet owner's or operators' scrapped or transferred diesel
23Class 6 truck, diesel Class 7 truck, or diesel Class 8 was used
24by the fleet owner or operator.
25 (h) Notwithstanding any other provision of this Section:
26 (1) a fleet owner or operator shall scrap a diesel

1 Class 6 truck, diesel Class 7 truck, or diesel Class 8
2 truck for which a grant is awarded under this Section if
3 the model year of the diesel Class 6 truck, diesel Class 7
4 truck, or diesel Class 8 truck is 2009 or older; and
5 (2) if the diesel Class 6 truck, diesel Class 7 truck,
6 or diesel Class 8 truck for which a grant is awarded under
7 this Section has a model year of 2010 or newer, the fleet
8 owner or operator must keep, donate, or sell that diesel
9 Class 6 truck, diesel Class 7 truck, or diesel Class 8
10 truck.
11 (i) The deployment of the electric Class 6 truck, electric
12Class 7 truck, or electric Class 8 truck in the applicant's
13fleet is required within 24 months after receipt of notice of
14approval of the applicant's Program application. Total
15completion of the project for which the electric Class 6
16truck, electric Class 7 truck, or electric Class 8 truck is
17purchased or leased must occur within 36 months after receipt
18of grant funds under the Program.
19 (j) An applicant who is awarded a grant under this Section
20must agree to participate in annual surveys regarding metrics
21as determined by the Agency, such as average daily mileage,
22kilowatts consumed, and emissions reduction data.
