Bill Title: Reinserts the provisions of the introduced bill with the following changes. Removes language providing that any vehicle owned by a governmental unit must either be a manufactured zero-emissions vehicle or converted into a zero-emissions vehicle no later than January 1, 2045. Establishes that all vehicles purchased or leased by a governmental unit after January 1, 2025, must be a zero-emissions vehicle or converted zero-emissions vehicle. Provides that a "zero-emissions" vehicle means a passenger (rather than a passenger and commercial) motor vehicle that produces zero exhaust emissions of any criteria pollutant, precursor pollutant, or greenhouse gas, but only produces water vapor, in any mode of operation or condition, as determined by the Agency. Requires the Environmental Protection Agency to adopt rules to implement and enforce the Act.

SYNOPSIS AS INTRODUCED:
New Act
30 ILCS 805/8.47 new

Creates the Government Zero Emission Vehicle Act. Defines terms. Provides that all vehicles owned by a governmental unit must either be a manufactured zero-emission vehicle or converted into a zero-emission vehicle no later than January 1, 2045. Requires the Environmental Protection Agency to adopt rules to implement the Act. Provides that the rules may include requirements for all governmental units to gradually reduce the percentage of vehicles that are not zero-emission vehicles up through January 1, 2045. Limits the concurrent exercise of home rule powers. Amends the State Mandates Act to require implementation without reimbursement.

1 AN ACT concerning government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 1. Short title. This Act may be cited as the
5Government Zero Emission Vehicle Act.
6 Section 5. Definitions. As used in this Act:
7 "Agency" means the Environmental Protection Agency.
8 "Governmental unit" means the State, a State agency, a
9unit of local government, or any other political subdivision
10of the State.
11 "Zero-emission vehicle" means a passenger or commercial
12motor vehicle that produces zero exhaust emissions of any
13criteria pollutant, precursor pollutant, or greenhouse gas,
14but only produces water vapor, in any mode of operation or
15condition, as determined by the Agency.
16 Section 10. Zero-emission vehicles of governmental units.
17Notwithstanding any other provision of law, all vehicles owned
18by a governmental unit must either be a manufactured
19zero-emission vehicle or converted into a zero-emission
20vehicle no later than January 1, 2045.
21 Section 15. Rules. The Environmental Protection Agency

1must adopt rules to implement this Act. The rules may include
2requirements for a governmental unit to gradually reduce the
3percentage of vehicles that are not zero-emission vehicles up
4through January 1, 2045.
5 Section 90. Home rule. A home rule unit may not regulate
6the unit's vehicles in a manner inconsistent with this Act.
7This Act is a limitation under subsection (i) of Section 6 of
8Article VII of the Illinois Constitution on the concurrent
9exercise by home rule units of powers and functions exercised
10by the State.
11 Section 99. The State Mandates Act is amended by adding
12Section 8.47 as follows:
13 (30 ILCS 805/8.47 new)
14 Sec. 8.47. Exempt mandate. Notwithstanding Sections 6 and
158 of this Act, no reimbursement by the State is required for
16the implementation of any mandate created by this amendatory
17Act of the 103rd General Assembly.
