Bill Title: Amends the Illinois Insurance Code to require certain insurance companies to comply with prohibitions under the Managed Care Reform and Patient Rights Act. Amends the Health Maintenance Organization Act. Changes the term "managed care organization" to "health maintenance organization" in a provision concerning an assessment imposed under the Illinois Public Aid Code. Effective immediately, except that provisions under the Illinois Insurance Code are effective January 1, 2020.

AN ACT concerning regulation.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Illinois Insurance Code is amended by
changing Section 155.36 as follows:
(215 ILCS 5/155.36)
Sec. 155.36. Managed Care Reform and Patient Rights Act.
Insurance companies that transact the kinds of insurance
authorized under Class 1(b) or Class 2(a) of Section 4 of this
Code shall comply with Sections 45, 45.1, 45.2, and 85,
subsection (d) of Section 30, and the definition of the term
"emergency medical condition" in Section 10 of the Managed Care
Reform and Patient Rights Act.

Section 10. The Health Maintenance Organization Act is
amended by changing Section 5-10 as follows:

Sec. 5-10. Health maintenance Managed care organizations;
revenue data.
(a) No health maintenance managed care organization shall
pass the cost of the assessment imposed pursuant to Article V-H
of the Illinois Public Aid Code on to consumers as a discrete
addition to their premiums.
(b) The Department shall provide the Department of
Healthcare and Family Services with member months and premium
revenue data needed for implementing the assessment imposed
under Article V-H of the Illinois Public Aid Code.

Section 99. Effective date. This Act takes effect upon
becoming law, except that Section 5 takes effect on January 1,
2020.
