Bill Title: Amends the Solid Waste Planning and Recycling Act. Provides that nothing in the Act shall be construed to permit a county with a population of less than 2,000,000 residents the power to regulate the operations of pollution control facilities or recycling centers. Effective immediately.

1 | AN ACT concerning safety.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Solid Waste Planning and Recycling Act is | ||||||
5 | amended by adding Section 9.5 as follows:
| ||||||
6 | (415 ILCS 15/9.5 new) | ||||||
7 | Sec. 9.5. Regulation of certain pollution control | ||||||
8 | facilities. No provision of this Act shall be construed to | ||||||
9 | allow any county with a population of less than 2,000,000 | ||||||
10 | residents to adopt an ordinance or resolution, except an | ||||||
11 | ordinance or resolution adopting a county plan in accordance | ||||||
12 | with Sections 4 and 5 of this Act, or implementing a county | ||||||
13 | plan in accordance with Section 7 of this Act, that requires | ||||||
14 | the issuance of a permit, or that imposes regulations upon the | ||||||
15 | operations of a municipal solid waste landfill unit, sanitary | ||||||
16 | landfill, storage site, transfer station, or waste disposal | ||||||
17 | site, as long as the facility obtains appropriate permits from | ||||||
18 | the Agency in accordance with Section 39 of the Environmental | ||||||
19 | Protection Act. Nothing in this amendatory Act of the 100th | ||||||
20 | General Assembly shall be construed to diminish or impair any | ||||||
21 | authority conferred upon a county under the Environmental | ||||||
22 | Protection Act, including, but not limited to, subsection (r) | ||||||
23 | of Section 4 and Section 39.2 of the Environmental Protection |

2 | Nothing in this amendatory Act of the 100th General | ||||||
3 | Assembly shall be construed to limit the authority of a county | ||||||
4 | to prepare or adopt a county plan pursuant to and in accordance | ||||||
5 | with Sections 4 and 5 of this Act, to implement a county plan | ||||||
6 | in accordance with Section 7 of this Act, or to relieve a | ||||||
7 | facility proposed for siting approval from demonstrating | ||||||
8 | consistency with that plan as required by criterion (viii) of | ||||||
9 | subsection (a) of Section 39.2 of the Environmental Protection | ||||||
10 | Act. | ||||||
11 | For the purposes of this Section, "municipal solid waste | ||||||
12 | landfill unit", "sanitary landfill", "storage site", "transfer | ||||||
13 | station", and "waste disposal site" have the meanings provided | ||||||
14 | to those terms in the Environmental Protection Act.

15 | Section 99. Effective date. This Act takes effect upon | ||||||
16 | becoming law.
