1 AN ACT concerning safety.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Solid Waste Planning and Recycling Act is
5amended by adding Section 9.5 as follows:
6 (415 ILCS 15/9.5 new)
7 Sec. 9.5. Regulation of certain pollution control
8facilities. No provision of this Act shall be construed to
9allow any county with a population of less than 2,000,000
10residents to adopt an ordinance or resolution, except an
11ordinance or resolution adopting a county plan in accordance
12with Sections 4 and 5 of this Act, or implementing a county
13plan in accordance with Section 7 of this Act, that requires
14the issuance of a permit, or that imposes regulations upon the
15operations of a municipal solid waste landfill unit, sanitary
16landfill, storage site, transfer station, or waste disposal
17site, as long as the facility obtains appropriate permits from
18the Agency in accordance with Section 39 of the Environmental
19Protection Act. Nothing in this amendatory Act of the 100th
20General Assembly shall be construed to diminish or impair any
21authority conferred upon a county under the Environmental
22Protection Act, including, but not limited to, subsection (r)
23of Section 4 and Section 39.2 of the Environmental Protection

1Act.
2 Nothing in this amendatory Act of the 100th General
3Assembly shall be construed to limit the authority of a county
4to prepare or adopt a county plan pursuant to and in accordance
5with Sections 4 and 5 of this Act, to implement a county plan
6in accordance with Section 7 of this Act, or to relieve a
7facility proposed for siting approval from demonstrating
8consistency with that plan as required by criterion (viii) of
9subsection (a) of Section 39.2 of the Environmental Protection
10Act.
11 For the purposes of this Section, "municipal solid waste
12landfill unit", "sanitary landfill", "storage site", "transfer
13station", and "waste disposal site" have the meanings provided
14to those terms in the Environmental Protection Act.
15 Section 99. Effective date. This Act takes effect upon
16becoming law.
