SYNOPSIS AS INTRODUCED:
230 ILCS 40/27

Amends the Video Gaming Act. Provides that a municipality or a county, with respect to unincorporated portions of the county, may impose specified separate requirements on video gaming that impose limitations on video gaming more restrictive than those provided under the Act. Effective immediately.

1 AN ACT concerning gaming.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Video Gaming Act is amended by changing
5Section 27 as follows:
6 (230 ILCS 40/27)
7 Sec. 27. Prohibition or limitation of video gaming by
8political subdivision.
9 (a) A municipality may pass an ordinance prohibiting video
10gaming within the corporate limits of the municipality. A
11county board may, for the unincorporated area of the county,
12pass an ordinance prohibiting video gaming within the
13unincorporated area of the county.
14 (b) A municipality or a county, with respect to
15unincorporated portions of the county, may impose separate
16requirements on video gaming that impose limitations on video
17gaming more restrictive than those provided under this Act.
18These requirements may include one or more of the following:
19 (1) Limitations on hours of video gaming terminal play
20 more restrictive than those provided under the liquor
21 license of a licensed establishment, licensed veterans
22 organization, or licensed fraternal organization.
23 (2) Limitations on the numbers of video gaming

1 terminals within a licensed establishment, licensed
2 veterans organization, licensed fraternal organization, or
3 licensed truck stop.
4 (3) Limitations on the total numbers of licensed
5 establishments, licensed veterans organizations, licensed
6 fraternal organizations, or licensed truck stops allowed
7 within the municipality or county, or a specific portion of
8 the municipality or county. These limitations may include
9 zoning restrictions to limit the areas within a
10 municipality or county where video gaming is permitted.

12 Section 99. Effective date. This Act takes effect upon
