Bill Title: Amends the Dietitian Nutritionist Practice Act. Provides that a "medically prescribed diet" may only be performed as initiated by or in consultation with a physician licensed under the Medical Practice Act of 1987 acting within the scope of his or her practice. Effective immediately.

1 | AN ACT concerning regulation.
| |||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 5. The Dietitian Nutritionist Practice Act is | |||||||||||||||||||
5 | amended by changing Section 10 as follows:
| |||||||||||||||||||
6 | (225 ILCS 30/10) (from Ch. 111, par. 8401-10)

7 | (Section scheduled to be repealed on January 1, 2023)
| |||||||||||||||||||
8 | Sec. 10. Definitions. As used in this Act:
| |||||||||||||||||||
9 | "Address of record" means the designated address recorded | |||||||||||||||||||
10 | by the Department in the applicant's or licensee's application
| |||||||||||||||||||
11 | file or license file as maintained by the Department's | |||||||||||||||||||
12 | licensure maintenance unit. It is the duty of the applicant or
| |||||||||||||||||||
13 | licensee to inform the Department of any change of address and | |||||||||||||||||||
14 | those changes must be made either through the Department's | |||||||||||||||||||
15 | website or by contacting the Department. | |||||||||||||||||||
16 | "Board" means the Dietitian Nutritionist Practice Board
| |||||||||||||||||||
17 | appointed by the Secretary.

18 | "Certified clinical nutritionist" means an individual | |||||||||||||||||||
19 | certified by the Clinical Nutrition Certification Board. | |||||||||||||||||||
20 | "Certified nutrition specialist" means an individual | |||||||||||||||||||
21 | certified by the Certification Board of Nutrition Specialists. | |||||||||||||||||||
22 | "Department" means the Department of Financial and | |||||||||||||||||||
23 | Professional Regulation.

1 | "Dietetics and nutrition services" means the integration | ||||||
2 | and application of principles derived from the sciences of food | ||||||
3 | and nutrition to provide for all aspects of nutrition care for | ||||||
4 | individuals and groups, including, but not limited to: | ||||||
5 | (1) nutrition counseling; "nutrition counseling" means | ||||||
6 | advising and assisting individuals or groups on | ||||||
7 | appropriate nutrition intake by integrating information | ||||||
8 | from the nutrition assessment; | ||||||
9 | (2) nutrition assessment; "nutrition assessment" means | ||||||
10 | the evaluation of the nutrition needs of individuals or | ||||||
11 | groups using appropriate data to determine nutrient needs | ||||||
12 | or status and make appropriate nutrition recommendations; | ||||||
13 | (3) medically prescribed diet; "medically prescribed | ||||||
14 | diet" means a diet prescribed when specific food or | ||||||
15 | nutrient levels need to be monitored, altered, or both as a | ||||||
16 | component of a treatment program for an individual whose | ||||||
17 | health status is impaired or at risk due to disease, | ||||||
18 | injury, or surgery and may only be performed as initiated | ||||||
19 | by or in consultation with a physician licensed under the | ||||||
20 | Medical Practice Act of 1987 acting within the scope of his | ||||||
21 | or her practice to practice medicine in all of its | ||||||
22 | branches ; | ||||||
23 | (4) medical nutrition therapy; "medical nutrition | ||||||
24 | therapy" means the component of nutrition care that deals | ||||||
25 | with: | ||||||
26 | (A) interpreting and recommending nutrient needs |

1 | relative to medically prescribed diets, including, but | ||||||
2 | not limited to, enteral feedings, specialized | ||||||
3 | intravenous solutions, and specialized oral feedings; | ||||||
4 | (B) food and prescription drug interactions; and | ||||||
5 | (C) developing and managing food service | ||||||
6 | operations whose chief function is nutrition care and | ||||||
7 | provision of medically prescribed diets; | ||||||
8 | (5) nutrition services for individuals and groups; | ||||||
9 | "nutrition services for individuals and groups" includes, | ||||||
10 | but is not limited to, all of the following: | ||||||
11 | (A) providing nutrition assessments relative to | ||||||
12 | preventive maintenance or restorative care; | ||||||
13 | (B) providing nutrition education and nutrition | ||||||
14 | counseling as components of preventive maintenance or | ||||||
15 | restorative care; and | ||||||
16 | (C) developing and managing systems whose chief | ||||||
17 | function is nutrition care; nutrition services for | ||||||
18 | individuals and groups does not include medical | ||||||
19 | nutrition therapy as defined in this Act; and | ||||||
20 | (6) restorative; "restorative" means the component of | ||||||
21 | nutrition care that deals with oral dietary needs for | ||||||
22 | individuals and groups; activities shall relate to the | ||||||
23 | metabolism of food and the requirements for nutrients, | ||||||
24 | including dietary supplements for growth, development, | ||||||
25 | maintenance, or attainment of optimal health.

26 | "Diplomate of the American Clinical Board of Nutrition" |
| |||||||
| |||||||
1 | means an individual certified by the American Clinical Board of | ||||||
2 | Nutrition.
| ||||||
3 | "Licensed dietitian nutritionist" means a person licensed | ||||||
4 | under this Act to
practice dietetics and nutrition services, as | ||||||
5 | defined in this Section.
Activities of a licensed dietitian | ||||||
6 | nutritionist do not include the medical
differential diagnosis | ||||||
7 | of the health status of an individual.
| ||||||
8 | "Practice experience" means a preprofessional, documented, | ||||||
9 | supervised
practice in dietetics or nutrition services that is | ||||||
10 | acceptable to the
Department in compliance with requirements | ||||||
11 | for licensure, as specified in Section
45. It may be or may | ||||||
12 | include a documented, supervised
practice experience which is a | ||||||
13 | component of the educational requirements
for licensure, as | ||||||
14 | specified in Section 45.
| ||||||
15 | "Registered dietitian" means an individual registered with | ||||||
16 | the Commission
on Dietetic Registration, the accrediting body | ||||||
17 | of the Academy of Nutrition and Dietetics, formerly known as | ||||||
18 | the American
Dietetic
Association.
| ||||||
19 | "Secretary" means the Secretary of Financial and | ||||||
20 | Professional Regulation.
