Bill Title: Amends the Public Community College Act. Provides that the Illinois Community College Board may collect a fee to cover the cost of processing and handling individual student-level data requests pursuant to an approved data sharing agreement. Renames the ICCB Instructional Development and Enhancement Applications Revolving Fund to the ICCB Research and Technology Fund. Provides that the Fund shall receive all moneys received from processing requests for individual student-level data, and that money from the Fund shall be used for costs associated with maintaining and updating individual student-level data systems. Amends the State Finance Act to make a conforming change. Effective July 1, 2017.

1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The State Finance Act is amended by changing
5Section 5.652 and by adding Section 5.878 as follows:
6 (30 ILCS 105/5.652)
7 Sec. 5.652. The ICCB Research and Technology Instructional
8Development and Enhancement Applications Revolving Fund.

11 Sec. 5.878. The BHE Data and Research Cost Recovery Fund.
12 Section 7. The Board of Higher Education Act is amended by
13adding Section 9.36 as follows:

15 Sec. 9.36. Processing fee.
16 (a) The Board may collect a fee to cover the cost of
17processing and handling individual student-level data requests
18pursuant to an approved data sharing agreement. The fee shall
19not be assessed on any entities that are complying with State
20or federal-mandated reporting. The fee shall be set by the

1Board by rule. Money from the fee shall be deposited into the
2BHE Data and Research Cost Recovery Fund.
3 (b) The Board may not provide personally identifiable
4information on individual students except in the case where an
5approved data sharing agreement is signed that includes
6specific requirements for safeguarding the privacy and
7security of any personally identifiable information in
8compliance with the federal Family Educational Rights and
9Privacy Act of 1974.
10 (c) The BHE Data and Research Cost Recovery Fund is created
11as a special fund in the State treasury. The Board shall
12deposit into the Fund moneys received from processing requests
13for individual student-level data. All moneys in the Fund shall
14be used by the Board, subject to appropriation, for costs
15associated with maintaining and updating the individual
16student-level data systems.
17 Section 10. The Public Community College Act is amended by
18changing Section 2-16.09 and by adding Section 2-11.2 as
19follows:
20 (110 ILCS 805/2-11.2 new)
21 Sec. 2-11.2. Processing fee.
22 (a) The State Board may collect a fee to cover the cost of
23processing and handling individual student-level data requests
24pursuant to an approved data sharing agreement. The fee shall

13 Sec. 2-16.09. ICCB Research and Technology Instructional
14Development and Enhancement Applications Revolving Fund. The
15ICCB Research and Technology Instructional Development and
16Enhancement Applications Revolving Fund is created as a special
17fund in the State treasury. The State Board shall deposit into
18the Fund moneys received by the State Board from the sale of
19instructional technology developed by the State Board and all
20moneys received from processing requests for individual
21student-level data. All moneys in the Fund shall be used by the
22State Board, subject to appropriation by the General Assembly,
23for costs associated with maintaining and updating that
24instructional technology and individual student-level data
25systems.
