Bill Title: Amends the Illinois Vehicle Code. Provides that the Secretary of State may issue such additional temporary driver's licenses to an applicant as are necessary to allow the applicant to drive during the pendency of an investigation and determination of all facts relative to such applicant's eligibility for such a license, valid for such a period as is appropriate, but in no event for longer than 90 days each. Effective immediately.

1 | AN ACT concerning transportation.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Illinois Vehicle Code is amended by | ||||||
5 | changing Section 6-105 as follows:
| ||||||
6 | (625 ILCS 5/6-105) (from Ch. 95 1/2, par. 6-105)
| ||||||
7 | Sec. 6-105.
Instruction permits and temporary licenses
for | ||||||
8 | persons 18 years of age or older.
| ||||||
9 | (a) Except as provided in this Section, the Secretary of | ||||||
10 | State upon
receiving proper application and payment of the | ||||||
11 | required fee may issue an
instruction permit to any person 18 | ||||||
12 | years of age or older
who is not ineligible for a license under
| ||||||
13 | paragraphs 1, 3, 4, 5, 7, or 8 of Section 6-103, after the | ||||||
14 | applicant has
successfully passed such examination as the | ||||||
15 | Secretary of State in his
discretion may prescribe.
| ||||||
16 | 1. An instruction permit entitles the holder while having | ||||||
17 | the permit in
his immediate possession to drive a motor | ||||||
18 | vehicle, excluding a motor driven
cycle or motorcycle, upon | ||||||
19 | the highways for a period of 12 months after the
date of its | ||||||
20 | issuance when accompanied by a licensed driver
who is 21 years | ||||||
21 | of age or older, who has had a
valid driver's license | ||||||
22 | classification to operate such vehicle for at least
one year | ||||||
23 | and has had one year of driving experience
with such |

1 | classification and who is occupying a seat beside the
driver.
| ||||||
2 | 2. A 12 month instruction permit for a motor driven cycle | ||||||
3 | or motorcycle
may be issued
to a person 18 years of age or | ||||||
4 | more, and entitles the holder to
drive upon the highways | ||||||
5 | during daylight under the direct supervision of a
licensed
| ||||||
6 | motor driven cycle operator or motorcycle operator
with the | ||||||
7 | same or
greater classification, who is 21 years of age or older | ||||||
8 | and who has at least
one year of driving experience.

9 | 3. (Blank).

10 | (b) (Blank).
| ||||||
11 | (c) The Secretary of State may issue a temporary
driver's | ||||||
12 | license to an applicant for a license permitting the operation
| ||||||
13 | of a motor vehicle while the Secretary is completing
an | ||||||
14 | investigation and determination of all facts relative to
such | ||||||
15 | applicant's eligibility to receive such license, or for any | ||||||
16 | other
reason prescribed by rule or regulation promulgated by | ||||||
17 | the Secretary of
State. Such permit must be in the applicant's | ||||||
18 | immediate possession
while operating a motor vehicle, and it | ||||||
19 | shall be invalid when the applicant's
driver's license has | ||||||
20 | been issued or for good cause has been refused.
In each case | ||||||
21 | the Secretary of State may issue the temporary driver's
| ||||||
22 | license for such period as appropriate but in no
event for | ||||||
23 | longer than 90 days. The Secretary may issue such additional | ||||||
24 | temporary driver's licenses to an applicant as are necessary | ||||||
25 | to allow the applicant to drive during the pendency of the | ||||||
26 | investigation, valid for such a period as is appropriate, but |
