Effective immediately.

SYNOPSIS AS INTRODUCED:
40 ILCS 5/3-148.5 new
40 ILCS 5/4-139.5 new

Amends the Downstate Police and Downstate Firefighter Articles of the Illinois Pension Code. Provides that, if not otherwise a party, the municipality is entitled to appear, as a matter of right, in any proceeding involving a participant or a beneficiary under the Articles that might result in a final administrative decision by the board. 1 AN ACT concerning public employee benefits.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Pension Code is amended by adding
5 Sections 3-148.5 and 4-139.5 as follows:
6 (40 ILCS 5/3-148.5 new)
7 Sec. 3-148.5. Right of employer to intervene. If not
8 otherwise a party, the municipality is entitled to appear, as a
9 matter of right, in any proceeding involving a participant or a
10 beneficiary under this Article that might result in a final
11 administrative decision by the board.
12 (40 ILCS 5/4-139.5 new)
13 Sec. 4-139.5. Right of employer to intervene. If not
14 otherwise a party, the municipality is entitled to appear, as a
15 matter of right, in any proceeding involving a participant or a
16 beneficiary under this Article that might result in a final
17 administrative decision by the board.
18 Section 99. Effective date. This Act takes effect upon
19 becoming law.
