Bill Title: Amends the Illinois Endangered Species Protection Act. Provides that the removal of an endangered animal from its habitat that is imminently necessary to avoid serious injury, additional injury, or death of the animal, does not violate the Illinois Endangered Species Protection Act. Requires a person who removes an animal under this Section to immediately take the endangered animal to an animal shelter. Requires both the person removing the animal and the animal shelter to report the removal to the Department of Natural Resources within 24 hours of the removal.

1 AN ACT concerning wildlife.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Endangered Species Protection Act
5is amended by adding Section 3.5 as follows:
6 (520 ILCS 10/3.5 new)
7 Sec. 3.5. Good samaritan exemption.
8 (a) It shall not be a violation of this Act to remove an
9endangered animal from its habitat if:
10 (1) the removal is imminently necessary to avoid
11 serious injury, additional injury, or death to an
12 endangered animal;
13 (2) reasonable care is taken to prevent any further
14 injury to the endangered animal;
15 (3) the endangered animal is immediately taken to an
16 animal shelter; and
17 (4) both the person removing the animal and the animal
18 shelter report the removal of the endangered animal to the
19 Department of Natural Resources within 24 hours of the
20 removal.
