Bill Title: Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois, the Hazardous Waste Technology Exchange Service Act, the Green Governments Illinois Act, the University of Illinois Exercise of Functions and Duties Law of the Civil Administrative Code of Illinois, the University of Illinois Scientific Surveys Act, the Toxic Pollution Prevention Act, the Illinois Low-Level Radioactive Waste Management Act, and the Wildlife Code. Changes references from the Waste Management and Research Center to the Illinois Sustainable Technology Center. Makes changes concerning the Green Governments Coordinating Council and references to the Illinois Natural History Survey, the Illinois State Water Survey, and the Illinois State Geological Survey. Makes changes with respect to the Prairie Research Institute, including providing that the Institute shall contain the Illinois State Archaeological Survey and changing the powers and duties of the Board of Trustees of the University of Illinois and the Scientific Surveys. Repeals a Section of the State Finance Act in relation to certain revenues deposited into the University of Illinois Income Fund and appropriations from the Natural Resources Information Fund. Makes technical changes. Effective immediately.

2 | AMENDMENT NO. ______. Amend Senate Bill 46 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The University of Illinois Trustees Act is | ||||||
5 | amended by changing Section 1 as follows:
| ||||||
6 | (110 ILCS 310/1) (from Ch. 144, par. 41) | ||||||
7 | Sec. 1. Membership. | ||||||
8 | (a) The Board of Trustees of the University of Illinois | ||||||
9 | shall consist
of the Governor and at least 12 trustees. Nine | ||||||
10 | trustees shall be
appointed by the Governor and the Board of | ||||||
11 | Directors of the University of Illinois Alumni Association as | ||||||
12 | provided under this subsection (a) , by and with the advice and | ||||||
13 | consent of
the Senate. The other trustees shall be students, of | ||||||
14 | whom one student shall
be selected from each University campus. | ||||||
15 | Two of the successors to the 3 trustees appointed by the | ||||||
16 | Governor whose terms expire in 2015 and their successors |

1 | thereafter shall be appointed by the Board of Directors of the | ||||||
2 | University of Illinois Alumni Association, and the other | ||||||
3 | trustee and his or her successors thereafter shall be appointed | ||||||
4 | by the Governor. Two of the successors to the 3 trustees | ||||||
5 | appointed by the Governor whose terms expire in 2017 and their | ||||||
6 | successors thereafter shall be appointed by the Board of | ||||||
7 | Directors of the University of Illinois Alumni Association, and | ||||||
8 | the other trustee and his or her successors thereafter shall be | ||||||
9 | appointed by the Governor. One of the successors to the 3 | ||||||
10 | trustees appointed by the Governor whose terms expire in 2019 | ||||||
11 | and his or her successors thereafter shall be appointed by the | ||||||
12 | Board of Directors of the University of Illinois Alumni | ||||||
13 | Association, and the other 2 trustees and their successors | ||||||
14 | thereafter shall be appointed by the Governor. Appointments by | ||||||
15 | the Board of Directors of the University of Illinois Alumni | ||||||
16 | Association shall be made in accordance with the association's | ||||||
17 | bylaws, provided that (i) nominations from the general public | ||||||
18 | must be considered, (ii) a nominee must not be rejected solely | ||||||
19 | because he or she is not an alumnus of the University of | ||||||
20 | Illinois, and (iii) a person must not be appointed as a trustee | ||||||
21 | for more than 2 consecutive full terms. | ||||||
22 | (b) Each student trustee shall serve a term of one year, | ||||||
23 | beginning on July 1 or
on the date of his or her selection, | ||||||
24 | whichever is later, and expiring on the
next succeeding June | ||||||
25 | 30. | ||||||
26 | (c) Each trustee shall have all of the privileges of |
| |||||||
| |||||||
1 | membership, except that only
one student trustee shall have the | ||||||
2 | right to cast a legally binding vote. The
Governor shall | ||||||
3 | designate which one of the student trustees shall possess, for
| ||||||
4 | his or her entire term, the right to cast a legally binding | ||||||
5 | vote. Each student
trustee who does not possess the right to | ||||||
6 | cast a legally binding vote shall
have the right to cast an | ||||||
7 | advisory vote and the right to make and second
motions and to | ||||||
8 | attend executive sessions. | ||||||
9 | (d) Each trustee shall be governed by the same conflict of | ||||||
10 | interest standards.
Pursuant to those standards, it shall not | ||||||
11 | be a conflict of interest for a
student trustee to vote on | ||||||
12 | matters pertaining to students generally, such as
tuition and | ||||||
13 | fees. However, it shall be a conflict of interest for a student
| ||||||
14 | trustee to vote on
faculty member
tenure or promotion. | ||||||
15 | (e)
Student trustees shall be chosen by campus-wide
student | ||||||
16 | election, and the
student trustee designated by the Governor to
| ||||||
17 | possess a legally binding vote shall be
one of the students | ||||||
18 | selected by this method. A student trustee who does not
possess | ||||||
19 | a legally binding vote on a
measure at a meeting of the
Board | ||||||
20 | or any of its committees shall not be considered a trustee
for | ||||||
21 | the purpose
of determining whether a quorum is present at the | ||||||
22 | time that measure is voted
upon. To be eligible for selection | ||||||
23 | as a
student trustee
and
to be eligible to remain as a voting | ||||||
24 | or nonvoting student trustee,
a student trustee must be a | ||||||
25 | resident of this State,
must have and maintain a
grade point | ||||||
26 | average that is equivalent to at least 2.5 on a 4.0 scale, and |

| |||||||
1 | must
be a full time student enrolled at all times during his or | ||||||
2 | her term of office
except
for that part of the term which | ||||||
3 | follows
the completion of the last full regular semester of an | ||||||
4 | academic year and
precedes the first full regular semester of | ||||||
5 | the succeeding academic year at the
University (sometimes | ||||||
6 | commonly referred to as the summer
session or summer
school). | ||||||
7 | If a voting or nonvoting student trustee
fails to
continue to | ||||||
8 | meet or maintain the residency, minimum grade point average, or
| ||||||
9 | enrollment requirement established by this Section, his
or her | ||||||
10 | membership on the Board shall be deemed to have terminated by | ||||||
11 | operation
of law. | ||||||
12 | If a voting student trustee resigns or otherwise ceases to | ||||||
13 | serve on the
Board, the Governor shall, within 30 days, | ||||||
14 | designate one of the remaining
student trustees to possess the | ||||||
15 | right to cast a legally binding vote
for the remainder of his | ||||||
16 | or her term. If a nonvoting student trustee resigns
or
| ||||||
17 | otherwise ceases to serve on the Board, the chief executive of | ||||||
18 | the
student government from that campus shall, within 30 days, | ||||||
19 | select
a new nonvoting student trustee to serve for the | ||||||
20 | remainder of the term. | ||||||
21 | (f) No more than 5 of the 9 appointed trustees
shall be | ||||||
22 | affiliated
with the same political party.
Each trustee | ||||||
23 | appointed by the Governor or the Board of Directors of the | ||||||
24 | University of Illinois Alumni Association must be a resident of | ||||||
25 | this State. A
failure to meet
or maintain this residency | ||||||
26 | requirement constitutes a resignation from and
creates a
|
| |||||||
| |||||||
1 | vacancy in the Board.
The term of office of each appointed | ||||||
2 | trustee
shall be 6 years from the third Monday in January of | ||||||
3 | each odd numbered year.
The regular terms of office of the
| ||||||
4 | appointed trustees shall be staggered so that 3 terms expire in | ||||||
5 | each
odd-numbered year. | ||||||
6 | Vacancies for appointed trustees shall be filled for the | ||||||
7 | unexpired term
in the same manner as
original appointments. If | ||||||
8 | a vacancy in membership occurs at a time when the
Senate is not | ||||||
9 | in session, the Governor or the Board of Directors of the | ||||||
10 | University of Illinois Alumni Association shall make temporary | ||||||
11 | appointments until
the next meeting of the Senate, when the | ||||||
12 | Governor or the Board of Directors of the University of | ||||||
13 | Illinois Alumni Association he shall appoint persons to fill | ||||||
14 | such
memberships for the remainder of their respective terms. | ||||||
15 | If the Senate is not
in session when appointments for a full | ||||||
16 | term are made, appointments shall be
made as in the case of | ||||||
17 | vacancies. | ||||||
18 | No action of the board shall be invalidated by reason of | ||||||
19 | any vacancies on
the board, or by reason of any failure to | ||||||
20 | select student trustees. | ||||||

23 | Section 99. Effective date. This Act takes effect January | ||||||
24 | 12, 2015.".
