Bill Title: Amends the Department of Central Management Services Law of the Civil Administrative Code of Illinois. Requires the Department of Central Management Services, in cooperation with the Department of Human Services, to develop and implement plans to increase the number of individuals with a disability employed by State government and to submit an annual report. Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois. Requires the Department of Commerce and Economic Opportunity, in cooperation with not-for-profit groups and community partners, to develop and implement an education and outreach campaign designed to increase statewide awareness of issues that affect individuals with a disability. Amends the Department of Human Services Act. Requires the Department of Human Services to collect information during the period of July 1, 2009 through June 30, 2010 regarding employers claims of the federal Work Opportunity Tax Credit and to submit an annual report. Amends the Illinois Procurement Code. Provides that a chief procurement officer may, as part of any solicitation, encourage prospective vendors to consider hiring qualified individuals with a disability and to notify them of any available financial incentives or other advantages associated with hiring such persons. Effective immediately.

1 AN ACT concerning persons with disabilities.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Department of Central Management Services
5 Law of the Civil Administrative Code of Illinois is amended by
6 adding Section 405-122 as follows:
7 (20 ILCS 405/405-122 new)
8 Sec. 405-122. Employees with a disability. The Department,
9 in cooperation with the Department of Human Services, the
10 Department of Employment Security, and other agencies of State
11 government shall develop and implement programs to increase the
12 number of qualified employees with disabilities working in the
13 State. The programs shall include provisions to increase the
14 number of people with a disability hired for positions with
15 specific job titles for which they have been assessed and
16 awarded a passing grade. The Department and the Department of
17 Human Services must submit a report, annually, to the Governor
18 and the General Assembly concerning their actions under this
19 Section.
20 Section 10. The Department of Human Services Act is amended
21 by adding Section 10-27 as follows:

2 Sec. 10-27. Information concerning federal tax credits and
3 deductions for hiring qualified employees with disabilities.
4 (a) The Department shall collect, during the period of July
5 1, 2009 through June 30, 2010, information regarding all of the
6 following:
7 (1) The number of employers that have claimed the Work
8 Opportunity Tax Credit and the amounts claimed during this
9 time frame.
10 (2) The size of the employer claiming the Work
11 Opportunity Tax Credit and whether the employer is a small
12 business or a large business.
13 (b) The Department shall cooperate with the Department of
14 Revenue, the Department of Employment Security, and other
15 appropriate agencies of State government to gather the
16 information required in items (1) and (2) of subsection (a).
17 (c) For the purposes of this Section:
18 "Large business" means a business concern, including
19 affiliates, which is not a small business.
20 "Small business" means a business concern, including
21 affiliates, with fewer than 16 employees or has gross annual
22 sales of less than $3 million.
23 (d) The Department shall submit a report, annually, to the
24 Governor and the General Assembly concerning its actions under
25 this Section.
26 Section 99. Effective date. This Act takes effect upon
