2 | RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE | ||||||
3 | HUNDREDTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that the | ||||||
4 | Rules of the House of Representatives of the 100th General
| ||||||
5 | Assembly are amended by changing Rules 16 and 67, and adding by | ||||||
6 | Rule 15.5 as follows:
| ||||||
7 | (House Rule 15.5 new)
| ||||||
8 | 15.5 Committee on Rules of Organization and Procedure.
| ||||||
9 | (a) The Committee on Rules of Organization and Procedure is | ||||||
10 | created as a permanent committee. The Committee shall consist | ||||||
11 | of 6 members, 3 appointed by the Speaker and 3 appointed by the | ||||||
12 | Minority Leader. The Speaker and the Minority Leader are each | ||||||
13 | eligible to be appointed to the Committee. The Committee may | ||||||
14 | conduct business when a majority of the total number of its | ||||||
15 | members has been appointed.

16 | (b) The majority caucus members of the Committee shall | ||||||
17 | serve at the pleasure of the Speaker, and the minority caucus | ||||||
18 | members shall serve at the pleasure of the Minority Leader. | ||||||
19 | Appointments shall be by notice filed with the Clerk, and shall | ||||||
20 | be effective for the balance of the term or until a replacement | ||||||
21 | appointment is made, whichever first occurs. Appointments take | ||||||
22 | effect upon filing with the Clerk, regardless of whether the | ||||||
23 | House is in session .

24 | The Committee may, with the concurrence of a majority of |

1 | those appointed, sponsor resolutions to adopt or amend rules of | ||||||
2 | organization and procedure for the House or Joint House-Senate | ||||||
3 | Rules. Notwithstanding any rule to the contrary, any resolution | ||||||
4 | approved for consideration by the Committee, pursuant to a vote | ||||||
5 | of a majority of those appointed, may be immediately considered | ||||||
6 | by the House without referral to any committee. | ||||||

9 | 16. Referrals of Resolutions and Reorganization Orders.
| ||||||
10 | (a) All resolutions, except adjournment resolutions and | ||||||
11 | resolutions
considered under subsection (b) or (c) of this | ||||||
12 | Rule, after being initially read
by the
Clerk, shall be ordered | ||||||
13 | reproduced and distributed as provided in Rule 39 and | ||||||
14 | automatically referred to the Rules
Committee, which may | ||||||
15 | thereafter refer any resolution
before it to the House or to a | ||||||
16 | standing committee or special committee. No
resolution, except | ||||||
17 | adjournment resolutions and resolutions considered under
| ||||||
18 | subsection (b), (c), or (d) of this Rule, may be considered by | ||||||
19 | the House
unless (i) referred to the House by the Rules | ||||||
20 | Committee under Rule 18, (ii) favorably reported by a
standing | ||||||
21 | committee or special committee, (iii) authorized under Article | ||||||
22 | XII, or (iv) discharged from committee pursuant to Rule 18(g) | ||||||
23 | or Rule 58 , or (v) approved for consideration by the Committee | ||||||
24 | on Rules of Organization and Procedure under subsection (a) of | ||||||
25 | Rule 67. An adjournment resolution is subject
to Rule 66.

1 | (b) Any member may file a congratulatory or death | ||||||
2 | resolution for consideration by the
House. The Principal | ||||||
3 | Sponsor of each congratulatory or death resolution shall pay a
| ||||||
4 | reasonable fee, determined by the Clerk with the approval of | ||||||
5 | the Speaker, to
offset the actual cost of producing the | ||||||
6 | congratulatory or death resolution. The fee may
be paid from | ||||||
7 | the office allowance provided by Section 4 of the General | ||||||
8 | Assembly
Compensation Act, or from any other funds available to | ||||||
9 | the member.
Upon agreement of the Speaker and the Minority | ||||||
10 | Leader, congratulatory or death
resolutions may be immediately | ||||||
11 | considered and adopted by the House
without referral to the | ||||||
12 | Rules Committee. Those resolutions may be adopted as a
group by | ||||||
13 | a single motion pursuant to a voice vote. A member may record a | ||||||
14 | vote of "present" or "no" for a particular resolution by filing | ||||||
15 | a notice with the Clerk to be included in the House Journal. | ||||||
16 | Congratulatory and death resolutions shall be
entered on the | ||||||
17 | Journal only by number, sponsorship, and subject. The
| ||||||
18 | provisions of this subsection requiring the Principal Sponsor | ||||||
19 | to pay a
reasonable fee may not be suspended.
| ||||||
20 | (c) Death resolutions in memory of former members of the | ||||||
21 | General Assembly
and
former
constitutional officers, upon | ||||||
22 | introduction, may be immediately considered by
the House | ||||||
23 | without referral to the Rules Committee. Those resolutions | ||||||
24 | shall be
entered on the Journal in full.
| ||||||
25 | (d) Executive reorganization orders of the Governor
issued | ||||||
26 | under Article V, Sec. 11 of the Constitution,
upon being read |
| |||||||
| |||||||
1 | into the record by the Clerk, are
automatically referred to the | ||||||
2 | Rules Committee for its
referral to a standing committee or a | ||||||
3 | special committee, which may
issue a recommendation to the | ||||||
4 | House with respect to the
Executive Order. The Rules Committee | ||||||
5 | may refer a resolution to disapprove an Executive Order to the | ||||||
6 | House if a
standing committee or a special committee has | ||||||
7 | reported to the House on the
Executive Order, or if the | ||||||
8 | Executive Order has
been discharged under Rule 58. The House | ||||||
9 | may disapprove of an
Executive Order by resolution adopted by a | ||||||
10 | majority of
those elected.

12 | (House Rule 67)
| ||||||
13 | 67. Adoption and Amendment to or Suspension of Rules.
| ||||||
14 | (a) Adoption of Rules. At the commencement of a term,
the | ||||||
15 | House shall adopt new rules of organization and procedure
by | ||||||
16 | resolution setting forth those rules in their entirety. The
| ||||||
17 | resolution must have been sponsored and approved for | ||||||
18 | consideration by the Committee on Rules of Organization and | ||||||
19 | Procedure, and it shall not be subject to amendment by the | ||||||
20 | House. The resolution shall be adopted by the affirmative vote | ||||||
21 | of a majority of those
elected.
These Rules of the House of | ||||||
22 | Representatives
are subject to revision or amendment
only in | ||||||
23 | accordance with this Rule.
| ||||||
24 | (b) Rules may be amended only by resolution sponsored by | ||||||
25 | the Committee on Rules of Organization and Procedure . Any

1 | resolution to amend these Rules or Joint House-Senate Rules | ||||||
2 | shall show the proposed changes in the
existing rules by | ||||||
3 | underscoring all new matter and by crossing
out with a line all | ||||||
4 | matter that is to be omitted or
superseded.
| ||||||
5 | (b-5) For the purpose of the organization and operation of | ||||||
6 | the House of Representatives, the rules adopted by and | ||||||
7 | applicable to the regular session of the House of | ||||||
8 | Representatives of the preceding General Assembly, insofar as | ||||||
9 | such rules may be applicable, shall prevail and be the rules | ||||||
10 | governing the House of Representatives of the General Assembly | ||||||
11 | then convened, until (i) such rules are changed or new rules | ||||||
12 | adopted, or (ii) the sixteenth day in the month of February in | ||||||
13 | the odd-numbered year. | ||||||
14 | (c) (Blank.) Any resolution proposing to amend a House Rule | ||||||
15 | or
any Joint House-Senate Rule, upon initial reading by
the | ||||||
16 | Clerk, is automatically referred to the Rules Committee.

17 | Resolutions to amend the House Rules or any Joint
House-Senate | ||||||
18 | Rules may be initiated and sponsored by the
Rules Committee and | ||||||
19 | may be amended by the Rules Committee; those resolutions shall | ||||||
20 | not be referred to a
committee and may be immediately | ||||||
21 | considered and adopted by the House.
Those resolutions shall be | ||||||
22 | assigned standard debate status,
subject to Rule 52.

23 | (d) (Blank.) A resolution to amend the House Rules or any | ||||||
24 | Joint
House-Senate Rules that has been reported "be adopted" or | ||||||
25 | "be adopted as amended" by a majority of those appointed to the
| ||||||
26 | Rules Committee requires the affirmative vote of a
majority of |
| |||||||
| |||||||
1 | those elected for adoption by the House. Any
other resolution | ||||||
2 | proposing to amend the House Rules or any
Joint House-Senate | ||||||
3 | Rules requires the affirmative vote
of 71 of the members | ||||||
4 | elected for adoption by the House.
| ||||||
5 | (e) No House Rule or any Joint House-Senate Rule may be
| ||||||
6 | suspended except by unanimous consent of the members
present or | ||||||
7 | upon a motion supported by the affirmative vote of a
majority | ||||||
8 | of those elected unless a higher number is required
in the Rule | ||||||
9 | sought to be suspended. A committee may not
suspend any Rule.

10 | (f) This Rule may be suspended only by the affirmative vote | ||||||
11 | of 71 members
elected.
