1 | HOUSE RESOLUTION
| ||||||
2 | WHEREAS, The right to privacy is a fundamental right | ||||||
3 | protected by the United States
Constitution and the Illinois | ||||||
4 | Constitution; and
| ||||||
5 | WHEREAS, Article I, Section 12 of the Illinois Constitution | ||||||
6 | provides for a remedy in the law for
"all injuries and wrongs" | ||||||
7 | to privacy; and
| ||||||
8 | WHEREAS, The citizens of Illinois have been subjected to an | ||||||
9 | ever-increasing amount of online
surveillance from private | ||||||
10 | companies that collect, share, and sell their data for profit | ||||||
11 | without their
knowledge or consent; and
| ||||||
12 | WHEREAS, According to the Pew Research Center, the distrust | ||||||
13 | of technology and technology
companies has reached an all-time | ||||||
14 | high, as over 80% of Americans believe they have very
little to | ||||||
15 | no control over their data, and that the potential risks of | ||||||
16 | collecting data now outweigh the
benefit of such collection; | ||||||
17 | and
| ||||||
18 | WHEREAS, In December of 2019, the National Institute of | ||||||
19 | Standards and Technology issued a
report finding concrete | ||||||
20 | evidence of racial bias in the use of facial recognition | ||||||
21 | technology,
concluding that the majority of face recognition |

1 | algorithms were significantly more likely to
inaccurately | ||||||
2 | identify a photograph of the face of an African-American or | ||||||
3 | East Asian person,
compared to the face of a white person; and
| ||||||
4 | WHEREAS, Current law fails to provide adequate protections | ||||||
5 | for children when it comes to the
collection, sharing, and | ||||||
6 | aggregation of all types of data; and
| ||||||
7 | WHEREAS, Illinois has long been a leader in protecting the | ||||||
8 | privacy of the citizens of Illinois
through the passage of the | ||||||
9 | Biometric Information Privacy Act, which prohibits companies | ||||||
10 | from
unlawfully collecting fingerprints and using facial | ||||||
11 | recognition without consent; and
| ||||||
12 | WHEREAS, Over the last decade, technological advancement | ||||||
13 | has significantly outpaced
current law, leading to significant | ||||||
14 | gaps in Illinois law and a "wild west" environment when it
| ||||||
15 | comes to the protection of the vast majority of consumer data; | ||||||
16 | therefore, be it
| ||||||
17 | RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE | ||||||
18 | HUNDRED FIRST GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that | ||||||
19 | we urge Illinois to continue to be a leader in
the protection | ||||||
20 | of the privacy of its citizens by codifying the Illinois | ||||||
21 | Constitution's fundamental
right of privacy, which includes: | ||||||
22 | (i) the right to consent before private data is collected or |

1 | shared,
(ii) the right to know with whom data is shared and | ||||||
2 | sold, (iii) the right to have a company delete
data upon | ||||||
3 | request, (iv) the right to opt-in to having data collected, | ||||||
4 | shared, or sold, and (v) the
right to data portability; and be | ||||||
5 | it further
| ||||||
6 | RESOLVED, That we declare January 28, 2020 as "Data Privacy | ||||||
7 | Day" in the State of Illinois.
