Requires that revenues in excess of a fiscal year's total aggregate appropriations must be deposited into a rainy day fund within the State treasury. Effective upon being declared adopted.

Proposes to amend the Finance Article of the Illinois Constitution. Limits each fiscal year's increase in total aggregate appropriations to the greater of 4% of the previous fiscal year's total aggregate appropriations or the sum of the rate of inflation and the State's population growth since the previous fiscal year. CONSTITUTIONAL AMENDMENT
3 RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
4NINETY-EIGHTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
5SENATE CONCURRING HEREIN, that there shall be submitted to the
6electors of the State for adoption or rejection at the general
7election next occurring at least 6 months after the adoption of
8this resolution a proposition to amend Article VIII of the
9Illinois Constitution by changing Section 2 as follows:

13SECTION 2. STATE FINANCE
14 (a) The Governor shall prepare and submit to the General
15Assembly, at a time prescribed by law, a State budget for the
16ensuing fiscal year. The budget shall set forth the estimated
17balance of funds available for appropriation at the beginning
18of the fiscal year, the estimated receipts, and a plan for
19expenditures and obligations during the fiscal year of every
20department, authority, public corporation and quasi-public
21corporation of the State, every State college and university,
22and every other public agency created by the State, but not of
23units of local government or school districts. The budget shall

1also set forth the indebtedness and contingent liabilities of
2the State and such other information as may be required by law.
3Proposed expenditures shall not exceed funds estimated to be
4available for the fiscal year as shown in the budget.
5 (b) The General Assembly by law shall make appropriations
6for all expenditures of public funds by the State.
7Appropriations for a fiscal year shall not exceed funds
8estimated by the General Assembly to be available during that
9year.
10 (c) The total aggregate appropriations for each fiscal year
11shall not exceed the previous fiscal year's total aggregate
12appropriations by the greater of 4% of the previous fiscal
13year's total aggregate appropriations or a percentage
14representing the sum of the percentage rate of inflation and
15the percentage rate of the State's population growth since the
16previous fiscal year. State revenues in excess of a fiscal
17year's total aggregate appropriations as calculated under this
18subsection shall be deposited into a rainy day fund within the
19State treasury established and to be used for purposes provided
20by law.

SCHEDULE
23 This Constitutional Amendment takes effect upon being
24declared adopted in accordance with Section 7 of the Illinois
25Constitutional Amendment Act.
