Bill Title: Amends the Legislature Article of the Illinois Constitution. Provides for a referendum to reject any Public Act by a petition signed by a number of electors. Provides signature and content requirements for the petition. Provides requirements for the validity and sufficiency of petitions. Provides that if a petition is valid and sufficient, the proposed referendum shall be submitted to the electors at the general election specified in the petition. Provides that if the voters in a specified election reject a Public Act, it shall cease to be in effect on the date specified in the referendum. Effective upon being declared adopted.

SYNOPSIS AS INTRODUCED:
ILCON Art. IV, Sec. 16 new

Amends the Legislature Article of the Illinois Constitutional. Provides for a referendum to reject any Public Act by a petition signed by a number of electors. Provides signature and content requirements for the petition. Provides requirements for the validity and sufficiency of petitions. Provides that if a petition is valid and sufficient, the proposed referendum shall be submitted to the electors at the general election specified in the petition. Provides that if the voters in a specified election reject a Public Act, it shall cease to be in effect on the date specified in the referendum. Effective upon being declared adopted.

3 RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE
4HUNDRED SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
5SENATE CONCURRING HEREIN, that there shall be submitted to the
6electors of the State for adoption or rejection at the general
7election next occurring at least 6 months after the adoption
8of this resolution a proposition to amend Article IV of the
9Illinois Constitution by adding Section 16 as follows:

13SECTION 16. INITIATIVE TO HOLD A REFERENDUM ON LEGISLATION
14 (a) A referendum to reject any Public Act, excepting
15appropriation measures, passed by the General Assembly and
16enacted into law may be proposed by a petition signed by a
17number of electors equal in number to at least 5% of the total
18votes cast for Governor in the preceding gubernatorial
19election. The petition shall be signed by the petitioning
20electors and filed with the State Board of Elections not more
21than 90 days after the enactment of the Public Act. A petition
22shall contain the Public Act number, the date of the general
23election at which the proposed amendment is to be submitted,

1and the date, if the Public Act is rejected, that it will cease
2to be in effect.
3 (b) The procedure for determining the validity and
4sufficiency of a petition shall be provided by law. If the
5petition is valid and sufficient, the proposed referendum
6shall be submitted to the electors at the general election
7specified in the petition. If the voters in the specified
8election reject the Public Act, it shall cease to be in effect
9on the date specified in the referendum.

SCHEDULE
11 This Constitutional Amendment takes effect upon being
12declared adopted in accordance with Section 7 of the Illinois
13Constitutional Amendment Act.
