1 AN ACT concerning transportation.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Vehicle Code is amended by changing
5Section 3-106 as follows:
6 (625 ILCS 5/3-106) (from Ch. 95 1/2, par. 3-106)
7 Sec. 3-106. Certificate of title - Issuance - Records.
8 (a) The Secretary of State shall file each application
9received and, when satisfied as to its genuineness and
10regularity, and that no tax imposed by the "Use Tax Act" or the
11vehicle use tax, as imposed by Section 3-1001 of "The Illinois
12Vehicle Code", or pursuant to the "Municipal Use Tax Act" or
13pursuant to the "County Use Tax Act" is owed as evidenced by
14the receipt for payment or determination of exemption from the
15Department of Revenue provided for in Section 3-104 of this
16Act, and that the applicant is entitled to the issuance of a
17certificate of title, shall issue a certificate of title of the
18vehicle.
19 (b) The Secretary of State shall maintain a record of all
20certificates of title issued by him under a distinctive title
21number assigned to the vehicle; and, in the discretion of the
22Secretary of State, in any other method determined.
23 (c) The Secretary of State shall not issue a certificate of

1title, including a certificate of title issued in accordance
2with subsection (b) of Section 3-109, to a manufactured home
3for which there has been recorded an affidavit of affixation
4pursuant to the Conveyance and Encumbrance of Manufactured
5Homes as Real Property and Severance Act unless with respect to
6the same manufactured home there has been recorded an affidavit
7of severance pursuant to the Conveyance and Encumbrance of
8Manufactured Homes as Real Property and Severance Act.
9 (d) The Secretary of State shall file, upon receipt, each
10affidavit of affixation and each affidavit of severance
11relating to a manufactured home that is delivered in accordance
12with the Conveyance and Encumbrance of Manufactured Homes as
13Real Property and Severance Act, when satisfied as to its
14genuineness and regularity.
15 (e) The Secretary of State shall maintain a record of each
16affidavit of affixation and each affidavit of severance filed
17in accordance with subsection (d) of this Section. The record
18shall state the name of the owner of the related manufactured
19home, the name of manufacturer, model year, manufacturer's
20serial number, and any other data the Secretary of State
21prescribes.
22 (f) The Secretary of State shall file, upon receipt, each
23application for surrender of the Manufacturer's Statement of
24Origin relating to a manufactured home that is delivered in
25accordance with Section 3-116.1, when satisfied as to its
26genuineness and regularity.

1 (g) The Secretary of State shall file, upon receipt, each
2application for surrender of the certificate of title relating
3to a manufactured home that is delivered in accordance with
4Section 3-116.2, when satisfied as to its genuineness and
5regularity.
6 (h) The Secretary of State shall maintain a record,
7including a record in the form of a searchable electronic
8database accessible to the public, of each Manufacturer's
9Statement of Origin accepted for surrender as provided in
10Section 3-116.1. The record shall state the date the
11Manufacturer's Statement of Origin was accepted for surrender,
12the name of manufacturer, make, model name, model year,
13manufacturer's serial number, and any other data the Secretary
14of State prescribes.
15 (i) The Secretary of State shall maintain a record,
16including a record in the form of a searchable electronic
17database accessible to the public, of each manufactured home
18certificate of title accepted for surrender as provided in
19Section 3-116.2. The record shall state the date the
20certificate of title was accepted for surrender, the name of
21manufacturer, model year, manufacturer's serial number, and
22any other data the Secretary of State prescribes.
23 (j) The Secretary of State shall remove the registration
24and license plate number record on file associated with a
25vehicle's serial number before issuing a new certificate of
26title for that vehicle.
