Bill Title: Amends the Mental Health and Developmental Disabilities Administrative Act. Requires the Department of Human Services to create a program to select people listed on the Department's Prioritization of the Urgency of Need of Services (PUNS) database to receive housing and community-based support services. Provides that by June 30, 2022, no less than 50% of the persons selected from the PUNS database shall qualify for or receive community-based support services under the State's Home and Community-Based Services Waiver for Persons with Developmental Disabilities (State's Waiver Program); and no less than 50% of the persons selected from the PUNS database shall qualify for or receive both housing and community-based support services funded by the Department. Provides that by June 30, 2022, the Department shall fully eliminate the 8-person community-integrated living arrangements model as a housing option for persons eligible for services under the State's Waiver program and shall instead implement a flexible housing model, as defined by the Department by rule, that utilizes a needs-based sliding scale to determine a person's eligibility and placement for housing. Contains provisions concerning reporting requirements. Provides that implementation of the provisions shall be contingent on the receipt of all necessary federal approvals.

SYNOPSIS AS INTRODUCED:

1 AN ACT concerning State government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Mental Health and Developmental
5Disabilities Administrative Act is amended by adding Section 76
6as follows:
7 (20 ILCS 1705/76 new)
8 Sec. 76. Equity in housing and support services.
9 (a) The Department of Human Services shall create a program
10to select people listed on the Department's Prioritization of
11the Urgency of Need of Services (PUNS) database to receive
12housing and community-based support services. By June 30, 2022,
13no less than 50% of the persons selected from the PUNS database
14shall qualify for or receive community-based support services
15under the State's Home and Community-Based Services Waiver for
16Persons with Developmental Disabilities. By June 30, 2022, no
17less than 50% of the persons selected from the PUNS database
18shall qualify for or receive both housing and community-based
19support services funded by the Department.
20 (b) By June 30, 2022, the Department shall fully eliminate
21the 8-person community-integrated living arrangements model as
22a housing option for persons eligible for services under the
23State's Home and Community-Based Services Waiver for Persons

1with Developmental Disabilities and shall instead implement a
2flexible housing model, as defined by the Department by rule.
3The flexible housing model shall utilize a needs-based sliding
4scale to determine a person's eligibility and placement for
5housing. The Department may adopt any rules necessary to
6implement the provisions of this subsection.
7 (c) The Department of Human Services, in collaboration with
8the Department of Healthcare and Family Services and any other
9interested State agencies, shall submit a report to the General
10Assembly on May 31, 2019, and each May 31 thereafter, that
11details the Department's progress in implementing the
12requirements under subsections (a) and (b).
13 (d) The Department, in collaboration with the Department of
14Healthcare and Family Services, shall apply for any federal
15waivers or approvals necessary to implement the provisions of
16this Section. Implementation of this Section shall be
17contingent upon the receipt of all necessary federal approvals.
