Bill Title: Amends the Department of State Police Law of the Civil Administrative Code of Illinois and the Illinois Police Training Act. Provides that the Department of State Police, for State Police officers, and the Illinois Law Enforcement Training Standards Board, for local law enforcement officers, shall adopt rules to require law enforcement officers to receive victim sensitivity training concerning the investigation of incidents of sexual assault and sexual abuse, including the interviewing of victims, when the victim of the sexual assault or sexual abuse is under 13 years of age for all probationary, full-time, and part-time law enforcement officers. SYNOPSIS AS INTRODUCED:

Amends the Department of State Police Law of the Civil Administrative Code of Illinois and the Illinois Police Training Act. Provides that the Department of State Police, for State Police officers, and the Illinois Law Enforcement Training Standards Board, for local law enforcement officers, shall adopt rules to require law enforcement officers to receive victim sensitivity training concerning the investigation of incidents of sexual assault and sexual abuse, including the interviewing of victims, when the victim of the sexual assault or sexual abuse is under 13 years of age for all probationary, full-time, and part-time law enforcement officers. Provides that the training shall be at least 40 hours and the officer shall receive and successfully complete the training every 5 years.

1 AN ACT concerning law enforcement training.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Department of State Police Law of the Civil
5Administrative Code of Illinois is amended by changing Section
62605-98 as follows:
7 (20 ILCS 2605/2605-98)
8 Sec. 2605-98. Training; sexual assault and sexual abuse.
9 (a) The Department of State Police shall conduct or approve
10training programs in trauma-informed responses and
11investigations of sexual assault and sexual abuse, which
12include, but is not limited to, the following:
13 (1) recognizing the symptoms of trauma;
14 (2) understanding the role trauma has played in a
15 victim's life;
16 (3) responding to the needs and concerns of a victim;
17 (4) delivering services in a compassionate, sensitive,
18 and nonjudgmental manner;
19 (5) interviewing techniques in accordance with the
20 curriculum standards in subsection (f) of this Section;
21 (6) understanding cultural perceptions and common
22 myths of sexual assault and sexual abuse; and
23 (7) report writing techniques in accordance with the

1 curriculum standards in subsection (f) of this Section.
2 (b) This training must be presented in all full and
3part-time basic law enforcement academies on or before July 1,
42018.
5 (c) The Department must present this training to all State
6police officers within 3 years after the effective date of this
7amendatory Act of the 99th General Assembly and must present
8in-service training on sexual assault and sexual abuse response
9and report writing training requirements every 3 years.
10 (d) The Department must provide to all State police
11officers who conduct sexual assault and sexual abuse
12investigations, specialized training on sexual assault and
13sexual abuse investigations within 2 years after the effective
14date of this amendatory Act of the 99th General Assembly and
15must present in-service training on sexual assault and sexual
16abuse investigations to these officers every 3 years.
17 (e) Instructors providing this training shall have
18successfully completed training on evidence-based,
19trauma-informed, victim-centered responses to cases of sexual
20assault and sexual abuse and have experience responding to
21sexual assault and sexual abuse cases.
22 (f) The Department shall adopt rules, in consultation with
23the Office of the Illinois Attorney General and the Illinois
24Law Enforcement Training Standards Board, to determine the
25specific training requirements for these courses, including,
26but not limited to, the following:

1 (1) evidence-based curriculum standards for report
2 writing and immediate response to sexual assault and sexual
3 abuse, including trauma-informed, victim-centered
4 interview techniques, which have been demonstrated to
5 minimize retraumatization, for all State police officers;
6 and
7 (2) evidence-based curriculum standards for
8 trauma-informed, victim-centered investigation and
9 interviewing techniques, which have been demonstrated to
10 minimize retraumatization, for cases of sexual assault and
11 sexual abuse for all State Police officers who conduct
12 sexual assault and sexual abuse investigations; and .
13 (3) victim sensitivity training concerning the
14 investigation of incidents of sexual assault and sexual
15 abuse, including the interviewing of victims, when the
16 victim of the sexual assault or sexual abuse is under 13
17 years of age for all recruits and sworn State Police
18 officers. The training shall be at least 40 hours and the
19 officer shall receive and successfully complete the
20 training every 5 years.

22 Section 10. The Illinois Police Training Act is amended by
23changing Section 10.21 as follows:

1 Sec. 10.21. Training; sexual assault and sexual abuse.
2 (a) The Illinois Law Enforcement Training Standards Board

1 (d) Agencies employing law enforcement officers who
2conduct sexual assault and sexual abuse investigations must
3provide specialized training to these officers on sexual
4assault and sexual abuse investigations within 2 years after

6must present in-service training on sexual assault and sexual
7abuse investigations to these officers every 3 years.
