1 AN ACT concerning business.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Consumer Fraud and Deceptive Business
5Practices Act is amended by adding Section 2WWW as follows:
6 (815 ILCS 505/2WWW new)
7 Sec. 2WWW. Unfair and deceptive advertising of room rates.
8 (a) As used in this Section:
9 "Casino hotel" has the meaning ascribed to that term in the
10North American Industry Classification System under code
11721120.
12 "Hotel" and "motel" have the meanings ascribed to those
13terms in the North American Industry Classification System
14under code 721110.
15 "Short-term rental" means a single-family dwelling, or a
16residential dwelling unit in a multi-unit structure,
17condominium, cooperative, timeshare, or similar joint property
18ownership arrangement that is rented for a fee for less than 30
19consecutive days. "Short-term rental" includes vacation
20rentals. "Short-term rental" does not include:
21 (1) a unit that is used for any non-residential
22 purpose, including educational, health care, retail,
23 restaurant, banquet space, event center, or another

1 similar uses;
2 (2) a bed and breakfast establishment as defined in
3 Section 2 of the Bed and Breakfast Act; or
4 (3) transient accommodations, including hotels and
5 motels that are not classified as residential property for
6 real property taxation purposes.
7 (b) No person shall advertise, or make available for
8inclusion in Internet search results, a rate for a casino
9hotel, hotel, motel, or other short-term lodging that does not
10include all required fees, excluding taxes and fees imposed by
11a government.
12 (c) A violation of this Section constitutes an unlawful
13practice within the meaning of this Act.
