AN ACT concerning business.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Consumer Fraud and Deceptive Business
Practices Act is amended by adding Section 2WWW as follows:
(815 ILCS 505/2WWW new)
Sec. 2WWW. Unfair and deceptive advertising of room rates.
(a) As used in this Section:
"Casino hotel" has the meaning ascribed to that term in the
North American Industry Classification System under code
721120.
"Hotel" and "motel" have the meanings ascribed to those
terms in the North American Industry Classification System
under code 721110.
"Short-term rental" means a single-family dwelling, or a
residential dwelling unit in a multi-unit structure,
condominium, cooperative, timeshare, or similar joint property
ownership arrangement that is rented for a fee for less than 30
consecutive days. "Short-term rental" includes vacation
rentals. "Short-term rental" does not include:
(1) a unit that is used for any non-residential
purpose, including educational, health care, retail,
restaurant, banquet space, event center, or another

similar uses;
(2) a bed and breakfast establishment as defined in
Section 2 of the Bed and Breakfast Act; or
(3) transient accommodations, including hotels and
motels that are not classified as residential property for
real property taxation purposes.
(b) No person shall advertise, or make available for
inclusion in Internet search results, a rate for a casino
hotel, hotel, motel, or other short-term lodging that does not
include all required fees, excluding taxes and fees imposed by
a government.
(c) A violation of this Section constitutes an unlawful
practice within the meaning of this Act.
