Bill Title: Creates the Compost-Amended Soil Construction Act. Provides that any State agency that undertakes a construction project that requires the use of offsite soil and that is located within 20 miles of any Illinois Environmental Protection Agency-permitted compost facility shall request a separate bid for compost-amended soil for that project. Provides that the State agency shall consider whether compost-amended soil shall be used based upon the construction cost. Provides that the State agency shall incorporate compost-amended soil into a construction project if the State agency deems the use of compost-amended soil to be appropriate. Provides that, in the 2019 calendar year, the Department of Transportation shall conduct 2 pilot road construction demonstrations using compost-amended soil. Provides that within one year of substantial completion of both projects, the Department shall report to the General Assembly stating the immediate cost of construction, long term operational cost savings, and advantages and disadvantages of using compost-amended soil.

1 | AN ACT concerning State government.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Illinois Procurement Code is amended by | ||||||
5 | adding Section 45-22 as follows:

6 | (30 ILCS 500/45-22 new) | ||||||
7 | Sec. 45-22. Compost-amended soil. | ||||||
8 | (a) As used in this Section: | ||||||
9 | "Compost-amended soil" means soil that has been mixed | ||||||
10 | with source separated landscape waste or a mixture of both | ||||||
11 | source separated landscape waste and source separated food | ||||||
12 | scraps to meet an organic matter content of not less than | ||||||
13 | 25%, where the compost component meets the certification | ||||||
14 | requirements of the U.S. Composting Council's Seal of | ||||||
15 | Testing Assurance (STA) program or any other equivalent, | ||||||
16 | nationally recognized program. | ||||||
17 | "State agency" means: all officers, boards, | ||||||
18 | commissions and agencies created by the Constitution in the | ||||||
19 | executive branch; all officers, departments, boards, | ||||||
20 | commissions, agencies, institutions, authorities, bodies | ||||||
21 | politic and corporate of the State; and administrative | ||||||
22 | units or corporate outgrowths of the State government which | ||||||
23 | are created by or pursuant to statute, other than |

1 | universities, units of local government and their | ||||||
2 | officers, school districts, and boards of election | ||||||
3 | commissioners; and all administrative units and corporate | ||||||
4 | outgrowths of the above and as may be created by executive | ||||||
5 | order of the Governor. | ||||||
6 | (b) Notwithstanding any provision of this Code or any other | ||||||
7 | law to the contrary, any State agency that undertakes a | ||||||
8 | landscaping project requiring the use of new or offsite soil | ||||||
9 | for landscape-related use and that is located within 10 miles | ||||||
10 | of any Illinois Environmental Protection Agency-permitted | ||||||
11 | compost facility shall request a base bid with an alternative | ||||||
12 | for compost-amended soil as a part of that project. The State | ||||||
13 | agency shall consider whether compost-amended soil should be | ||||||
14 | used for that project based upon the costs. The State agency | ||||||
15 | shall incorporate compost-amended soil into a landscaping | ||||||
16 | project if the cost of using compost-amended soil is equal to | ||||||
17 | or less than the cost of using other new offsite soil. | ||||||
18 | The Illinois Environmental Protection Agency shall | ||||||
19 | maintain a list of the locations of all permitted compost | ||||||
20 | facilities in the State and post the list on its website. | ||||||
21 | (c) Prior to December 31, 2019, the Department of | ||||||
22 | Transportation shall conduct 2 pilot demonstration projects | ||||||
23 | using compost-amended soil. The Department shall determine the | ||||||
24 | costs and advantages and disadvantages of using | ||||||
25 | compost-amended soil. Within one year of substantial | ||||||
26 | completion of both projects, the Department shall report to the |
