1 AN ACT concerning finance.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Procurement Code is amended by
5changing Section 53-10 as follows:
6 (30 ILCS 500/53-10)
7 Sec. 53-10. Concessions and leases of State property and
8no-cost contracts.
9 (a) Except for property under the the jurisdiction of a
10public institution of higher education, concessions, including
11the assignment, license, sale, or transfer of interests in or
12rights to discoveries, inventions, patents, or copyrightable
13works, may be entered into by the State agency with
14jurisdiction over the property, whether tangible or
15intangible.
16 (b) Except for property under the jurisdiction of a public
17institution of higher education, all leases of State property
18and concessions shall be reduced to writing and shall be
19awarded under the provisions of Article 20, except that the
20contract shall be awarded to the highest bidder or best bidder
21or offeror when the State receives a lease payment, a
22percentage of sales from the lessee, or in-kind support from
23the lessee based on the return to the State.

1 (c) Except for property under the jurisdiction of a public
2institution of higher education, all no-cost procurements
3shall be reduced to writing and shall be awarded under the
4provisions of Article 20 of this Code. All awards of no-cost
5procurements shall identify the estimated business value to the
6lessee and the value to the State.
