Bill Title: Amends the Medical Practice Act of 1987. Exempts physicians from disciplinary action by the Department of Financial and Professional Regulation based solely upon the licensee's recommendation or provision of a treatment method for Lyme disease or other tick-borne disease if specified criteria are met. Effective immediately.

1 | AN ACT concerning regulation.
| |||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 5. The Medical Practice Act of 1987 is amended by | |||||||||||||||||||
5 | adding Section 22.6 as follows:
| |||||||||||||||||||
6 | (225 ILCS 60/22.6 new) | |||||||||||||||||||
7 | Sec. 22.6. Discipline exemption for Lyme disease | |||||||||||||||||||
8 | treatment. | |||||||||||||||||||
9 | (a) A person licensed by the Department to practice | |||||||||||||||||||
10 | medicine under this Act shall not be subject to disciplinary | |||||||||||||||||||
11 | action based solely upon the licensee's recommendation or | |||||||||||||||||||
12 | provision of a treatment method for Lyme disease or other | |||||||||||||||||||
13 | tick-borne disease if the recommendation or provision of the | |||||||||||||||||||
14 | treatment meets all of the following criteria: | |||||||||||||||||||
15 | (1) the treatment is provided after an examination is | |||||||||||||||||||
16 | performed and the patient has given informed consent; | |||||||||||||||||||
17 | (2) the licensee identifies a medical reason for | |||||||||||||||||||
18 | recommending or providing the treatment; | |||||||||||||||||||
19 | (3) the treatment is provided after the licensee | |||||||||||||||||||
20 | informs the patient about other recognized treatment | |||||||||||||||||||
21 | options and describes to the patient the licensee's | |||||||||||||||||||
22 | education, experience, and credentials regarding the | |||||||||||||||||||
23 | treatment of Lyme disease or other tick-borne disease; |

1 | (4) the licensee uses the licensee's own medical | ||||||
2 | judgment based on a thorough review of all available | ||||||
3 | clinical information on Lyme disease or other tick-borne | ||||||
4 | disease literature to determine the best course of | ||||||
5 | treatment for the individual patient; and | ||||||
6 | (5) the treatment will not, in the opinion of licensee, | ||||||
7 | result in the direct and proximate death of or serious | ||||||
8 | bodily injury to the patient.

9 | Section 99. Effective date. This Act takes effect upon | ||||||
10 | becoming law.
