1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 1. Short title. This Act may be cited as the Higher
5Education COVID-19 Vaccine Requirement Prohibition Act.
6 Section 5. Definitions. As used in this Act:
7 "Institution of higher education" means an institution
8located in this State that is either (i) a public college or
9university or (ii) a nonpublic college or university that has
10received any funding assistance or any public funds from the
11State of Illinois in the previous fiscal year.
12 "Vaccine credential" means any written or electronic
13record evidencing that a person has received a vaccine.
14 Section 10. COVID-19 vaccine requirement prohibited.
15Notwithstanding any requirements under the College Student
16Immunization Act or rules of the Department of Public Health
17to the contrary, an institution of higher education may not
18require a person to obtain a COVID-19 vaccination or show a
19COVID-19 vaccine credential as a condition of enrollment at
20the institution of higher education or participation as a
21student in any of its programs.

1 Section 90. The College Student Immunization Act is
2amended by changing Section 2 as follows:
3 (110 ILCS 20/2) (from Ch. 144, par. 2602)
4 Sec. 2. Proof of immunization. No person shall attend a
5post-secondary educational institution without presenting
6proof that he or she has received such immunizations against
7preventable communicable diseases as the Department shall
8require by rules and regulations promulgated pursuant to this
9Act and the Communicable Disease Prevention Act "An Act in
10relation to the prevention of certain communicable diseases",
11approved July 5, 1967, as now or hereafter amended, except as
12provided in Section 3 of this Act and except as otherwise
13provided in the Higher Education COVID-19 Vaccine Requirement
14Prohibition Act. The proof of immunization required by this
15Section shall be presented to the post-secondary educational
16institution.

18 Section 99. Effective date. This Act takes effect upon
