1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The University of Illinois Act is amended by
5changing Section 1d as follows:
6 (110 ILCS 305/1d) (from Ch. 144, par. 22d)
7 Sec. 1d. Child care services.
8 (a) For the purposes of this Section, "child care services"
9means day care home or center services as defined by the Child
10Care Act of 1969.
11 (b) The Board may contract for the provision of child care
12services for its employees and shall contract for the provision
13of child care services on campus for its students. The Board
14may, in accordance with established rules, allow day care
15centers to operate in State-owned or leased facilities. Such
16day care centers shall be primarily for use by State employees
17or students of the university but use by non-employees or
18non-students may be allowed.
19 Where the Board enters into a contract to construct,
20acquire or lease all or a substantial portion of a building, in
21which more than 50 persons shall be employed, other than a
22renewal of an existing lease, after July 1, 1992, and where a
23need has been demonstrated, according to subsection (c),

1on-site child care services shall be provided for employees of
2the university.
3 The Board shall implement this Section and shall promulgate
4all rules and regulations necessary for this purpose. By April
51, 1993, the Board shall propose rules setting forth the
6standards and criteria, including need and feasibility, for
7determining if on-site child care services for employees shall
8be provided. The Board shall consult with the Department of
9Children and Family Services in defining standards for child
10care service centers established pursuant to this Section to
11ensure compliance with the Child Care Act of 1969. The Board
12shall establish a schedule of fees that shall be charged for
13child care services under this Section. The schedule shall be
14established so that charges for service for employees are based
15on the actual cost of care and charges for service for students
16are reduced or service is free of charge, depending on the
17student's income. Except as otherwise provided by law for
18employees who may qualify for public assistance or social
19services due to indigency or family circumstance, each employee
20obtaining child care services under this Section shall be
21responsible for full payment of all charges. The Board shall
22report, on or before December 31, 1993, to the Governor and the
23members of the General Assembly, on the feasibility and
24implementation of a plan for the provision of comprehensive
25child care services.
26 (c) Prior to contracting for child care services for its

1employees, the Board shall determine a need for child care
2services. Proof of need may include a survey of university
3employees as well as a determination of the availability of
4child care services through other State agencies, or in the
5community. The Board may also require submission of a
6feasibility, design, and implementation plan, that takes into
7consideration similar needs and services for employees of other
8State universities.
9 (d) The Board shall have the sole responsibility for
10choosing the successful bidder and overseeing the operation of
11its child care service program within the guidelines
12established by the Board. The Board shall promulgate rules
13under the Illinois Administrative Procedure Act that detail the
14specific standards to be used in the selection of a vendor of
15child care services.
16 The contract shall provide for the establishment of or
17arrangement for the use of a licensed day care center or a
18licensed day care agency, as defined in the Child Care Act of
191969.

22Act is amended by changing Section 8b.1 as follows:

3 Section 45. The Western Illinois University Law is amended
4by changing Section 35-95 as follows:
5 (110 ILCS 690/35-95)
6 Sec. 35-95. Child care services.
7 (a) For the purposes of this Section, "child care services"
8means day care home or center services as defined by the Child
9Care Act of 1969.
10 (b) The Board may contract for the provision of child care
11services for its employees and shall contract for the provision
12of child care services on campus for its students. The Board
13may, in accordance with established rules, allow day care
14centers to operate in State-owned or leased facilities. Such
15day care centers shall be primarily for use by State employees
16or students of Western Illinois University but use by
17non-employees or non-students may be allowed.
18 Where the Board enters into a contract to construct,
19acquire or lease all or a substantial portion of a building, in
20which more than 50 persons shall be employed, other than a
21renewal of an existing lease, and where a need has been
22demonstrated, according to subsection (c), on-site child care
23services shall be provided for employees of Western Illinois
24University.

1 The Board shall implement this Section and shall promulgate
2all rules and regulations necessary for this purpose. By
3September 1, 1996, the Board shall propose rules setting forth
4the standards and criteria, including need and feasibility, for
5determining if on-site September child care services for
6employees shall be provided. The Board shall consult with the
7Department of Children and Family Services in defining
8standards for child care service centers established pursuant
9to this Section to ensure compliance with the Child Care Act of
101969. The Board shall establish a schedule of fees that shall
11be charged for child care services under this Section. The
12schedule shall be established so that charges for service for
13employees are based on the actual cost of care and charges for
14service for students are reduced or service is free of charge,
15depending on the student's income. Except as otherwise provided
16by law for employees who may qualify for public assistance or
17social services due to indigency or family circumstance, each
18employee obtaining child care services under this Section shall
19be responsible for full payment of all charges. The Board shall
20report, on or before December 31, 1996, to the Governor and the
21members of the General Assembly, on the feasibility and
22implementation of a plan for the provision of comprehensive
23child care services.
24 (c) Prior to contracting for child care services for its
25employees, the Board shall determine a need for child care
26services. Proof of need may include a survey of University

1employees as well as a determination of the availability of
2child care services through other State agencies, or in the
3community. The Board may also require submission of a
4feasibility, design, and implementation plan that takes into
5consideration similar needs and services for employees of other
6State universities.
7 (d) The Board shall have the sole responsibility for
8choosing the successful bidder and overseeing the operation of
9its child care service program within the guidelines
10established by the Board. The Board shall promulgate rules
11under the Illinois Administrative Procedure Act that detail the
12specific standards to be used in the selection of a vendor of
13child care services.
14 The contract shall provide for the establishment of or
15arrangement for the use of a licensed day care center or a
16licensed day care agency, as defined in the Child Care Act of
171969.

19 Section 50. The Public Community College Act is amended by
20adding Section 3-29.14 as follows:

22 Sec. 3-29.14. Child care services for students. A board
23shall contract for the provision of child care services on
24campus for its students. Charges for service shall be at a

1reduced rate or service shall be free of charge, depending on
2the student's income. The contract shall provide for the
3establishment of or arrangement for the use of a licensed day
4care center or a licensed day care agency, as defined in the
5Child Care Act of 1969.
6 Section 99. Effective date. This Act takes effect upon
7becoming law.
