SYNOPSIS AS INTRODUCED:
105 ILCS 5/1A-12 new

Amends the School Code. Creates the Tax Credit Scholarship Commission. Provides for the membership of the Commission. Provides that the Commission shall set standards for the tax credit scholarship program created under the Invest in Kids Act, gather information about the program, and hold hearings open to the public that explain the program. Provides that the Commission shall report on the information gathered about the program and make recommendations to the General Assembly on or before January 1, 2019, and every year thereafter for a period of 5 years. Effective immediately.

1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The School Code is amended by adding Section
51A-12 as follows:
6 (105 ILCS 5/1A-12 new)
7 Sec. 1A-12. Tax Credit Scholarship Commission.
8 (a) There is hereby created the Tax Credit Scholarship
9Commission within the State Board of Education which shall
10consist of the following members:
11 (1) two members appointed by the President of the
12 Senate;
13 (2) two members appointed by the Minority Leader of the
14 Senate;
15 (3) two members appointed by the Speaker of the House
16 of Representatives;
17 (4) two members appointed by the Minority Leader of the
18 House of Representatives; and
19 (5) two members appointed by the Governor.
20 (b) The Commission shall:
21 (1) with input from members of the General Assembly,
22 school board members, the State Board of Education, and
23 other experts, set standards for the tax credit scholarship

1 program created under the Invest in Kids Act;
2 (2) gather information from schools, school districts,
3 parents, the State Board of Education, and legal experts
4 regarding the legality of the tax credit scholarship
5 program and how to make the program function for students
6 and their families; and
7 (3) hold hearings open to the public that explain the
8 tax credit scholarship program.
9 (c) The Commission shall issue a report on the information
10gathered on the tax credit scholarship program and any
11recommendations to the General Assembly on or before January 1,
122019, and every year thereafter for a period of 5 years.
13 (d) The State Board of Education shall provide staff and
14administrative support to the Commission and shall have the
15ability to receive input from the public about the tax credit
16scholarship program.
17 (e) This Section is repealed on December 31, 2024.
18 Section 99. Effective date. This Act takes effect upon
19becoming law.
