Bill Title: Amends the Public Community College Act. Requires the student member of the Board of Trustees of Community College District No. 536 to be a voting (rather than nonvoting) student member. Permits the board of trustees of any other community college district to elect to allow a student member to be a voting student member. Provides that if a board decides to terminate or not renew the employment contract of the president of a community college, then, for one year after the decision was voted upon, no person who was a member of the board at the time of the vote may be selected to serve as president of the community college. Makes related changes. Effective immediately.

1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Public Community College Act is amended by
5changing Sections 3-7.24 and 3-9 and by adding Section 3-80 as
6follows:
7 (110 ILCS 805/3-7.24) (from Ch. 122, par. 103-7.24)
8 Sec. 3-7.24. Student board member.
9 (a) Each community college board shall have one non-voting
10member who is a student enrolled in the community college under
11the jurisdiction of the board. One non-voting student member
12shall also be selected in multi-campus districts to represent
13all campuses in those districts. In multi-campus districts, the
14campus from which the member is selected shall be determined by
15lot each year, provided that no campus shall twice have
16selected a non-voting student member until all campuses in the
17district have once been represented on the district board. The
18same procedure shall be followed until all campuses have been
19represented a second time, a third time, and subsequent times.
20The method of selecting these student members shall be
21determined by campus-wide student referendum.
22 (b) A The student member members shall serve a term of one
23year beginning on April 15 of each year, except that the

1student member initially selected shall serve a term beginning
2on the date of selection and expiring on the next succeeding
3June 30.
4 (c) Except as otherwise provided in subsection (d), a
5student member shall be a nonvoting student member. Nonvoting
6The nonvoting student members shall have all of the privileges
7of membership, including the right to make and second motions
8and to attend executive sessions, other than the right to vote.
9 (d) The student member of the Board of Trustees of
10Community College District No. 536 shall be a voting student
11member. The board of any other community college district may
12elect to allow a student member to be a voting student member.
13A voting student member shall have all of the privileges of
14membership, including the right to make and second motions and
15to attend executive sessions and the right to vote on all board
16matters except those involving faculty tenure, faculty
17promotion, or any issue on which the student member has a
18direct conflict of interest. For the purposes of this
19subsection (d), the student member shall not be deemed to have
20a direct conflict of interest in and may vote on any item
21involving the employment or compensation of the president of
22the community college or the election of officers.

25 Sec. 3-9. A majority of full voting membership of the Board

1shall constitute a quorum. However, a voting student member who
2is not entitled to vote on a measure at a meeting of the Board
3or any of its committees shall not be considered a member for
4the purpose of determining whether a quorum is present at the
5time that measure is voted upon. For all meetings of the Board,
6a quorum of members must be physically present at the location
7of the meeting. When a vote is taken upon any measure before
8the Board, a quorum being present, a majority of the members
9voting on the measure shall determine the outcome thereof. No
10action of such board shall be invalidated by reason of any
11vacancies on such board, or by reason of any failure to select
12any nonvoting student members.

15 Sec. 3-80. Termination or nonrenewal of employment
16contract; president. If a board decides to terminate or not
17renew the employment contract of the president of a community
18college, then, for one year after the decision was voted upon,
19no person who was a member of the board at the time of the vote
20may be selected to serve as president of the community college.
21 Section 99. Effective date. This Act takes effect upon
22becoming law.
