1 | AN ACT concerning safety.

2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 5. The Public Water Supply Regulation Act is | ||||||||||||||||||||||||
5 | amended by adding Section 14a as follows:

6 | (415 ILCS 40/14a new) | ||||||||||||||||||||||||
7 | Sec. 14a. Sale of water resources. | ||||||||||||||||||||||||
8 | (a) Notwithstanding any other provision of law, on and | ||||||||||||||||||||||||
9 | after this effective date of this amendatory Act of the 101st | ||||||||||||||||||||||||
10 | General Assembly, the State or a unit of local government may | ||||||||||||||||||||||||
11 | not contract for the sale of water resources for a period | ||||||||||||||||||||||||
12 | longer than 4 years, inclusive of extensions or renewals of the | ||||||||||||||||||||||||
13 | contract. | ||||||||||||||||||||||||
14 | (b) A home rule unit may not regulate the sale of water | ||||||||||||||||||||||||
15 | resources in a manner inconsistent with this Section. This | ||||||||||||||||||||||||
16 | Section is a limitation under subsection (i) of Section 6 of | ||||||||||||||||||||||||
17 | Article VII of the Illinois Constitution on the concurrent | ||||||||||||||||||||||||
18 | exercise by home rule units of powers and functions exercised | ||||||||||||||||||||||||
19 | by the State.
