1 AN ACT concerning State government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Gubernatorial Boards and Commissions Act is
5amended by adding Section 25 as follows:
6 (15 ILCS 50/25 new)
7 Sec. 25. Dissolution of inactive boards and commissions.
8 (a) Within 10 days after the effective date of this
9amendatory Act of the 97th General Assembly, the Governor shall
10make reasonable efforts to notify each statutorily created
11board or commission of (i) the reporting requirement imposed
12under subsection (b), and (ii) the right of the board or
13commission to request that the Governor prevent the dissolution
14of the board or commission under subsection (e).
15 (b) Within 30 days after the effective date of this
16amendatory Act of the 97th General Assembly, each statutorily
17created board or commission not subject to subsection (g) shall
18report to the Secretary of State on that board's or
19commission's last meeting prior to the effective date of this
20amendatory Act of the 97th General Assembly, and the report
21shall include the date, time, and location of the meeting.
22 (c) Within 60 days after the 30-day period set forth in
23subsection (b), the Secretary of State shall submit a report to

1the Governor, the Secretary of the Senate, and the Clerk of the
2House of Representatives, listing all statutorily created
3boards and commissions that have not met in the 2 years
4immediately preceding the effective date of this amendatory Act
5of the 97th General Assembly. If a board or commission not
6subject to subsection (g) does not report to the Secretary of
7State pursuant to this subsection, then it shall be deemed to
8be inactive and subject to the provisions of subsections (d)
9and (e).
10 (d) Unless the Governor acts pursuant to subsection (e), if
11a board or commission has not met at least once during the 2
12years prior to the effective date of this amendatory Act of the
1397th General Assembly and is reported as inactive pursuant to
14subsection (b), then the board or commission is dissolved at
15the end of the 75-day period set forth in subsection (e).
16 (e) Within 75 days after the Governor's receipt of the
17report submitted by the Secretary of State under subsection
18(c), the Governor may prevent the dissolution of any inactive
19board or commission by filing a written statement with the
20Secretary of State and the Senate that authorizes the continued
21existence of the board or commission and provides a rationale
22for why the board or commission needs to exist. Before the
23expiration of the 75-day period set forth in this subsection,
24each board or commission may request that the Governor prevent
25the dissolution of the board or commission in accordance with
26this subsection.

1 (f) Within 14 days after the 75-day period set forth in
2subsection (e), the Governor shall publish a list of all boards
3and commissions dissolved under subsection (d). The
4Legislative Reference Bureau shall prepare for introduction no
5later than in the annual session of the General Assembly next
6occurring after the list is published by the Governor a
7revisory bill effecting such changes in the statutes as may be
8necessary to conform the statutes to the changes in law made by
9the dissolution of the boards and commissions included in the
10list published by the Governor. The failure of the General
11Assembly to enact such a bill does not affect the validity of
12the dissolution of any board or commission under this Section.
13 (g) Any board or commission created after July 1, 2010 is
14exempt from this Section.
