Bill Title: Amends the Gubernatorial Boards and Commissions Act. Provides that if a board or commission has not met at least once during a period of 2 consecutive years, then the board or commission is dissolved immediately after that 2-year period. Effective immediately.

1 | AN ACT concerning State government.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Gubernatorial Boards and Commissions Act is | ||||||
5 | amended by adding Section 25 as follows:

7 | Sec. 25. Dissolution of inactive boards and commissions. | ||||||
8 | (a) Within 10 days after the effective date of this | ||||||
9 | amendatory Act of the 97th General Assembly, the Governor shall | ||||||
10 | make reasonable efforts to notify each statutorily created | ||||||
11 | board or commission of (i) the reporting requirement imposed | ||||||
12 | under subsection (b), and (ii) the right of the board or | ||||||
13 | commission to request that the Governor prevent the dissolution | ||||||
14 | of the board or commission under subsection (e). | ||||||
15 | (b) Within 30 days after the effective date of this | ||||||
16 | amendatory Act of the 97th General Assembly, each statutorily | ||||||
17 | created board or commission not subject to subsection (g) shall | ||||||
18 | report to the Secretary of State on that board's or | ||||||
19 | commission's last meeting prior to the effective date of this | ||||||
20 | amendatory Act of the 97th General Assembly, and the report | ||||||
21 | shall include the date, time, and location of the meeting. | ||||||
22 | (c) Within 60 days after the 30-day period set forth in | ||||||
23 | subsection (b), the Secretary of State shall submit a report to |

1 | the Governor, the Secretary of the Senate, and the Clerk of the | ||||||
2 | House of Representatives, listing all statutorily created | ||||||
3 | boards and commissions that have not met in the 2 years | ||||||
4 | immediately preceding the effective date of this amendatory Act | ||||||
5 | of the 97th General Assembly. If a board or commission not | ||||||
6 | subject to subsection (g) does not report to the Secretary of | ||||||
7 | State pursuant to this subsection, then it shall be deemed to | ||||||
8 | be inactive and subject to the provisions of subsections (d) | ||||||
9 | and (e). | ||||||
10 | (d) Unless the Governor acts pursuant to subsection (e), if | ||||||
11 | a board or commission has not met at least once during the 2 | ||||||
12 | years prior to the effective date of this amendatory Act of the | ||||||
13 | 97th General Assembly and is reported as inactive pursuant to | ||||||
14 | subsection (b), then the board or commission is dissolved at | ||||||
15 | the end of the 75-day period set forth in subsection (e). | ||||||
16 | (e) Within 75 days after the Governor's receipt of the | ||||||
17 | report submitted by the Secretary of State under subsection | ||||||
18 | (c), the Governor may prevent the dissolution of any inactive | ||||||
19 | board or commission by filing a written statement with the | ||||||
20 | Secretary of State and the Senate that authorizes the continued | ||||||
21 | existence of the board or commission and provides a rationale | ||||||
22 | for why the board or commission needs to exist. Before the | ||||||
23 | expiration of the 75-day period set forth in this subsection, | ||||||
24 | each board or commission may request that the Governor prevent | ||||||
25 | the dissolution of the board or commission in accordance with | ||||||
26 | this subsection. |

1 | (f) Within 14 days after the 75-day period set forth in | ||||||
2 | subsection (e), the Governor shall publish a list of all boards | ||||||
3 | and commissions dissolved under subsection (d). The | ||||||
4 | Legislative Reference Bureau shall prepare for introduction no | ||||||
5 | later than in the annual session of the General Assembly next | ||||||
6 | occurring after the list is published by the Governor a | ||||||
7 | revisory bill effecting such changes in the statutes as may be | ||||||
8 | necessary to conform the statutes to the changes in law made by | ||||||
9 | the dissolution of the boards and commissions included in the | ||||||
10 | list published by the Governor. The failure of the General | ||||||
11 | Assembly to enact such a bill does not affect the validity of | ||||||
12 | the dissolution of any board or commission under this Section. | ||||||
13 | (g) Any board or commission created after July 1, 2010 is | ||||||
14 | exempt from this Section.
