Bill Title: Amends the Illinois Municipal Retirement Fund (IMRF) Article of the Illinois Pension Code. Provides that the Fund shall post on its publicly available website the following information regarding municipalities that participate in the Fund that the Fund has in its possession: (1) copies of all resolutions adopted by a municipality on or after January 1, 1995 to participate in the Fund if such a resolution was required; (2) an annual report listing each municipality and the date each municipality first became a municipality that participates in the Fund; (3) all documents pertaining to each municipality's annual projected future contributions to the Fund; and (4) information about the amount of each municipality's past required contributions to the Fund for each year of participation on or after January 1, 1995 and before, if available. Requires municipalities to post to its website a link to that information. Specifies that the provisions do not require the Fund to post on its website information that is exempt from disclosure under the Freedom of Information Act and do not require a municipality to establish or maintain a website. Amends the State Mandates Act to require implementation without reimbursement by the State. Effective July 1, 2020.

SYNOPSIS AS INTRODUCED:

30 ILCS 805/8.43 new

Amends the Illinois Municipal Retirement Fund (IMRF) Article of the Illinois Pension Code. Provides that a participating municipality or instrumentality shall post on its publicly available website, if the participating municipality or instrumentality maintains a publicly available website: (1) all documents pertaining to the municipality's or instrumentality's adoption of a resolution to participate in the Fund if the municipality or instrumentality has adopted such a resolution; (2) all documents pertaining to the municipality's or instrumentality's annual projected future contributions to the Fund; and (3) information about the amount of the municipality's or instrumentality's past required contributions to the Fund for each year of participation. Provides that the public posting requirement does not require a participating municipality or instrumentality to post on its website information that is not subject to disclosure under the Freedom of Information Act. Amends the State Mandates Act to require implementation without reimbursement by the State. Effective immediately.

1 AN ACT concerning public employee benefits.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Pension Code is amended by adding
5Section 7-135.5 as follows:
6 (40 ILCS 5/7-135.5 new)
7 Sec. 7-135.5. Required public posting of information by
8participating municipalities and instrumentalities. A
9participating municipality or instrumentality shall post on
10its publicly available website, if the participating
11municipality or instrumentality maintains a publicly available
12website: (1) all documents pertaining to the municipality's or
13instrumentality's adoption of a resolution to participate
14under this Article if the municipality or instrumentality has
15adopted such a resolution; (2) all documents pertaining to the
16municipality's or instrumentality's annual projected future
17contributions under this Article; and (3) information about the
18amount of the municipality's or instrumentality's past
19required contributions to the Fund for each year of
20participation. This Section does not require a participating
21municipality or instrumentality to post on its website
22information that is exempt from disclosure under the Freedom of
23Information Act.

1 Section 90. The State Mandates Act is amended by adding
2Section 8.43 as follows:
3 (30 ILCS 805/8.43 new)
4 Sec. 8.43. Exempt mandate. Notwithstanding Sections 6 and 8
5of this Act, no reimbursement by the State is required for the
6implementation of any mandate created by this amendatory Act of
7the 101st General Assembly.
8 Section 99. Effective date. This Act takes effect upon
9becoming law.
