SYNOPSIS AS INTRODUCED:
430 ILCS 15/8 new

Amends the Gasoline Storage Act. Provides that every filling station or service station open to the general public shall make available, at each filling station or service station, self-service dispensing equipment that dispenses mid-grade E15 for use in motor vehicles and motor vehicle engines and shall offer mid-grade E15 for sale. Provides that every filling station or service station subject to the requirements of the provisions shall comply with specified labeling requirements that apply to retailers and wholesale purchaser-consumers of gasoline-ethanol blends that contain greater than 10% by volume of ethanol and not more than 15% by volume of ethanol. Provides that the requirements of the provisions shall not apply to specified filling stations. Effective January 1, 2023.

1 AN ACT concerning safety.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Gasoline Storage Act is amended by adding
5Section 8 as follows:
6 (430 ILCS 15/8 new)
7 Sec. 8. E15 consumer choice.
8 (a) The General Assembly finds that:
9 (1) E15 is a blend of gasoline and up to 15% by volume
10 of ethanol.
11 (2) Ethanol is a renewable domestic fuel that burns
12 cleaner than gasoline.
13 (3) Illinois is the third largest ethanol producing
14 state in the nation, with 13 ethanol plants that can
15 produce 1.6 billion gallons of ethanol per year.
16 (4) The United States Environmental Protection Agency
17 has approved the use of E15 in cars of the model year 2001
18 or later.
19 (5) E15 is significantly less expensive than
20 conventional gasoline, with expected savings between 5 and
21 15 cents per gallon.
22 (6) According to the Argonne National Laboratory,
23 higher ethanol blends such as E15 will help expand use of

1 corn ethanol, which reduces greenhouse gas emissions by
2 34% relative to those of gasoline.
3 (7) Transportation accounts for 21% of all greenhouse
4 gas emissions in the city.
5 (8) Infrastructure provides access to cleaner
6 alternative fuels.
7 (b) Every filling station or service station open to the
8general public shall make available, at each filling station
9or service station, self-service dispensing equipment that
10dispenses mid-grade E15 for use in motor vehicles and motor
11vehicle engines and shall offer mid-grade E15 for sale.
12 (c) Every self-service filling station subject to the
13requirements of this Section shall comply with the labeling
14requirements of 40 C.F.R. 80.1501 that apply to retailers and
15wholesale purchaser-consumers of gasoline-ethanol blends that
16contain greater than 10% by volume of ethanol and not more than
1715% by volume of ethanol.
18 (d) The requirements of this section shall not apply to:
19 (1) a filling station at which the average annual
20 volume of fuel sales is less than 850,000 gallons;
21 (2) a filling station at which the underground storage
22 tanks are not compatible with the storage of blended fuel
23 in accordance with Section 175.415 of Chapter I of Title
24 41 of the Illinois Administrative Code, as amended; and
25 (3) a filling station located at a marina.
26 (e) In this Section:

1 "Marina" means a facility located on a body of water that
2provides for the storage (wet and dry), launching, and mooring
3of pleasure boats together with one or more accessory retail
4and service uses, such as marine equipment sales, showers,
5private clubs and restaurants.
6 "Mid-grade E15" means a gasoline-ethanol blend with an 88
7octane rating or higher that contains greater than 10% by
8volume of ethanol and not more than 15% by volume of ethanol.
9 "Watercraft" means any boat, vessel, or other craft used
10or capable of being used as a means of transportation on water.
11 Section 99. Effective date. This Act takes effect January
121, 2023.
