Bill Title: Amends the Environmental Protection Act. Provides that the disposal by incineration of aqueous film-forming foam that contains any perfluoroalkyl and polyfluoroalkyl substance is prohibited in Illinois. Provides that the Agency may adopt any rules or regulations it deems necessary in order to carry out the amendatory provisions. Effective immediately.

1 AN ACT concerning safety.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Environmental Protection Act is amended by
5adding Section 22.62 as follows:
6 (415 ILCS 5/22.62 new)
7 Sec. 22.62. PFAS; incineration.
8 (a) In this Section:
9 "Incineration" includes, but is not limited to, burning,
10combustion, pyrolysis, gasification, thermal oxidation,
11including flameless and regenerative, or the use of an acid
12recovery furnace or oxidizer, ore roaster, cement kiln,
13lightweight aggregate kiln, industrial furnace, boiler, or
14process heater.
15 "Perfluoroalkyl and polyfluoroalkyl substances" or "PFAS"
16means a class of fluorinated organic chemicals containing at
17least one fully fluorinated carbon atom.
18 (b) The disposal by incineration of any perfluoroalkyl and
19polyfluoroalkyl substance, including, but not limited to,
20aqueous film forming foam, is prohibited in Illinois. The
21Agency may adopt any rules or regulations it deems necessary
22in order to carry out the provisions of this Section.

1 Section 99. Effective date. This Act takes effect upon
2becoming law.
