Bill Title: Amends the Department of Natural Resources (Conservation) Law of the Civil Administrative Code of Illinois. Provides that the Department of Natural Resources may assess specified consultation fees up to $500 (rather than assess a $500 fee). Deletes language providing that the Department shall not assess any fee for consultations requested by a State agency or federal agency.

AN ACT concerning State government.
| ||||
Be it enacted by the People of the State of Illinois,
| ||||
represented in the General Assembly:
| ||||
Section 5. The Department of Natural Resources | ||||
(Conservation) Law of the
Civil Administrative Code of Illinois | ||||
is amended by changing Section 805-555 as follows:

Sec. 805-555. Consultation fees. | ||||
(a) For the purposes of this Section, "agency" shall have | ||||
the meaning assigned in Section 1-20 of the Illinois | ||||
Administrative Procedure Act. | ||||
(b) The Department shall assess a $100 $500 fee for | ||||
consultations conducted under subsection (b) of Section 11 of | ||||
the Illinois Endangered Species Protection Act and Section 17 | ||||
of the Illinois Natural Areas Preservation Act. The Department | ||||
shall not assess any fee for consultations requested by a State | ||||
agency or federal agency. Any fee assessed under this Section | ||||
shall be deposited into the Illinois Wildlife Preservation | ||||
Fund. | ||||
(c) The Department may adopt rules to implement this | ||||
Section. | ||||
(d) The monies deposited into the Illinois Wildlife | ||||
Preservation Fund under this Section shall not be subject to |
administrative charges or chargebacks unless otherwise | ||
authorized by this Act.
