Bill Title: Creates the Protection of Individuals with Disabilities in the Criminal Justice System Task Force Act of 2019. Re-establishes the Protection of Individuals with Disabilities in the Criminal Justice System Task Force. Specifies membership and appointment of the Task Force. Provides that the Guardianship and Advocacy Commission shall provide administrative and other support to the Task Force. Provides that the Task Force shall consider issues that affect adults and juveniles with disabilities with respect to their involvement with the police, detention and confinement in correctional facilities, representation by counsel, participation in the criminal justice system, communications with their families, awareness and accommodations for their disabilities, and concerns for the safety of the general public and individuals working in the criminal justice system. Provides that the Task Force shall make recommendations to the Governor and to the General Assembly regarding policies, procedures, legislation, and other actions that can be taken to protect the public safety and the well-being and rights of individuals with disabilities in the criminal justice system. Provides that the Task Force shall submit a report with its findings and recommendations to the Governor, the Attorney General, and to the General Assembly on or before September 30, 2020. Repeals Act on January 1, 2022. Effective immediately.

| 1 | AN ACT concerning State government.
| ||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 1. Short title. This Act may be cited as the | ||||||
| 5 | Protection of Individuals with Disabilities in the Criminal
| ||||||
| 6 | Justice System Task Force Act of 2019.
| ||||||
| 7 | Section 5. Protection of Individuals with Disabilities in
| ||||||
| 8 | the Criminal Justice System Task Force; members. | ||||||
| 9 | (a) There is created the Protection of Individuals with
| ||||||
| 10 | Disabilities in the Criminal Justice System Task Force ("Task
| ||||||
| 11 | Force") consisting of 28 members, one member appointed by the
| ||||||
| 12 | Attorney General, one liaison of the Office of the Governor and
| ||||||
| 13 | 15 other members appointed by the Governor, 2 circuit judges
| ||||||
| 14 | appointed by the Supreme Court, one member appointed by the
| ||||||
| 15 | State Treasurer, one member appointed by the Guardianship and
| ||||||
| 16 | Advocacy Commission, and 4 members of the General Assembly, one
| ||||||
| 17 | each appointed by the Speaker of the House of Representatives,
| ||||||
| 18 | the Minority Leader of the House of Representatives, the
| ||||||
| 19 | President of the Senate, and the Minority Leader of the Senate.
| ||||||
| 20 | The appointments shall be made within 90 days after the
| ||||||
| 21 | effective date of this Act. | ||||||
| 22 | (b) The members shall reflect the racial, ethnic, and
| ||||||
| 23 | geographic diversity and diversity of disabilities of this
| ||||||
| |||||||
| |||||||
| 1 | State and include: | ||||||
| 2 | (1) Circuit judges who preside over criminal cases; | ||||||
| 3 | (2) State's Attorneys; | ||||||
| 4 | (3) Public Defenders; | ||||||
| 5 | (4) representatives of organizations that advocate for
| ||||||
| 6 | persons with developmental and intellectual disabilities; | ||||||
| 7 | (5) representatives of organizations that advocate for
| ||||||
| 8 | persons with physical disabilities; | ||||||
| 9 | (6) representatives of organizations that advocate for
| ||||||
| 10 | persons with mental illness; | ||||||
| 11 | (7) representatives of organizations that advocate for
| ||||||
| 12 | adolescents and youth; | ||||||
| 13 | (8) a representative from the Guardianship and
| ||||||
| 14 | Advocacy Commission; | ||||||
| 15 | (9) sheriffs or their designees; | ||||||
| 16 | (10) chiefs of municipal police departments or their
| ||||||
| 17 | designees; | ||||||
| 18 | (11) individuals with disabilities; | ||||||
| 19 | (12) parents or guardians of individuals with
| ||||||
| 20 | disabilities; | ||||||
| 21 | (13) community-based providers of services to persons
| ||||||
| 22 | with disabilities; | ||||||
| 23 | (14) a representative of a service coordination
| ||||||
| 24 | agency; and | ||||||
| 25 | (15) a representative of an organization that provides | ||||||
| 26 | independent oversight of correctional facilities. | ||||||

| |||||||
| 1 | (c) The following State officials shall serve as ex-officio
| ||||||
| 2 | members of the Task Force: | ||||||
| 3 | (1) a liaison of the Governor's Office; | ||||||
| 4 | (2) the Attorney General or his or her designee; | ||||||
| 5 | (3) the Director of State Police or his or her
| ||||||
| 6 | designee; | ||||||
| 7 | (4) the Secretary of Human Services or his or her
| ||||||
| 8 | designee; | ||||||
| 9 | (5) the Director of Corrections or his or her designee; | ||||||
| 10 | (6) the Director of Juvenile Justice or his or her
| ||||||
| 11 | designee; | ||||||
| 12 | (7) the Director of the Guardianship and Advocacy
| ||||||
| 13 | Commission or his or her designee; | ||||||
| 14 | (8) the Director of the Illinois Criminal Justice
| ||||||
| 15 | Information Authority or his or her designee; | ||||||
| 16 | (9) the State Treasurer or his or her designee; | ||||||
| 17 | (10) the Director of Children and Family Services or | ||||||
| 18 | his or her designee; | ||||||
| 19 | (11) the Department of Juvenile Justice Independent | ||||||
| 20 | Juvenile Ombudsman; and | ||||||
| 21 | (12) the Director of the Illinois Law Enforcement | ||||||
| 22 | Training Standards Board. | ||||||
| 23 | (d) The members of the Task Force shall serve without
| ||||||
| 24 | compensation. | ||||||
| 25 | (e) The Task Force members shall elect one of the appointed
| ||||||
| 26 | members to serve as a co-chair of the Task Force at the first
| ||||||
| |||||||
| |||||||
| 1 | meeting of the Task Force. The other co-chair shall be the
| ||||||
| 2 | liaison of the Governor's Office. | ||||||
| 3 | (f) The Guardianship and Advocacy Commission shall provide
| ||||||
| 4 | administrative and other support to the Task Force.
| ||||||
| 5 | Section 10. Task Force duties. The Task Force shall
| ||||||
| 6 | consider issues that affect adults and juveniles with
| ||||||
| 7 | disabilities with respect to their involvement with the police,
| ||||||
| 8 | detention and confinement in correctional facilities,
| ||||||
| 9 | representation by counsel, participation in the criminal
| ||||||
| 10 | justice system, communications with their families, awareness
| ||||||
| 11 | and accommodations for their disabilities, and concerns for the
| ||||||
| 12 | safety of the general public and individuals working in the
| ||||||
| 13 | criminal justice system. The Task Force shall make
| ||||||
| 14 | recommendations to the Governor and to the General Assembly
| ||||||
| 15 | regarding policies, procedures, legislation, and other actions
| ||||||
| 16 | that can be taken to protect the public safety and the
| ||||||
| 17 | well-being and rights of individuals with disabilities in the
| ||||||
| 18 | criminal justice system.
| ||||||
| 19 | Section 15. Meetings. The Task Force shall meet at least 4
| ||||||
| 20 | times, with the first meeting taking place no later than 120
| ||||||
| 21 | days after the effective date of this Act.
| ||||||
| 22 | Section 20. Report. The Task Force shall submit a report
| ||||||
| 23 | with its findings and recommendations to the Governor, the
| ||||||

| 1 | Attorney General, and to the General Assembly on or before
| ||||||
| 2 | September 30, 2020.
| ||||||
| 3 | Section 25. Repeal. This Act is repealed on January 1, | ||||||
| 4 | 2022.
| ||||||
| 5 | Section 99. Effective date. This Act takes effect upon | ||||||
| 6 | becoming law.
