Bill Title: Amends the Fire Protection of Unprotected Area Act. Provides that if a property owner of an unprotected area refuses a request for annexation for fire protection, the State Fire Marshal shall assign the unprotected area coverage. Amends the Illinois Insurance Code. Provides that in order to obtain property insurance for property located in an unincorporated area of a county, the owner of the property must submit verification that the property has fire protection coverage by a fire protection jurisdiction. Effective January 1, 2018.

1 AN ACT concerning regulation.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Fire Protection District Act is amended by
5adding Section 3.3 as follows:
6 (70 ILCS 705/3.3 new)
7 Sec. 3.3. Annexation of covered areas. A fire protection
8district may annex into its jurisdiction property for which the
9district is providing coverage under Section 10.2 of the
10Emergency Telephone System Act by adoption of an ordinance
11annexing the property. In addition to the required public
12notifications prior to an ordinance adoption, the fire
13protection district shall give notice by U.S. certified mail at
14least 20 days prior to the hearing to the property owner or
15owners of the time and place of the hearing and a copy of the
16proposed ordinance. At the hearing, all persons having an
17interest in the matter shall have an opportunity to be heard.
18Following adoption of the annexation ordinance, a certified
19copy of the annexation ordinance shall be transmitted by the
20secretary of the district to each of the following: the county
21clerk of the county in which the property is located; the
22Office of the State Fire Marshal; and the owner or owners of
23the property or properties annexed by the ordinance. On the

1date specified in the annexation ordinance, the property or
2properties shall become an integral part of the fire protection
3district and subject to all of the benefits of service and
4responsibilities of the district.
5 Section 99. Effective date. This Act takes effect January
